Lapse of time or never had a right or privilege. I would recommend hiring a lawyer for a non-monetary default eviction. The court forms do not track this type of eviction so based on your sophistication you may spend a considerable amount of time and if you are off in the slightest the court will withhold judgment.

I think the $100 fee per trip to show a unit is ridiculous. However, if I had a client who was self-managing certain processes and was doing leasing on their own I would build in a fee structure to avoid my company getting taken advantage of. I.e. I am not going to just send a body to show a unit in which we are not getting leasing on for free.

I bought a HUD owned condo with an FHA loan. I used the first time home buyer tax credit and literally walked with cash from the closing table. In my area the deals were still not really there in 2009/2009 so I don't regret not purchasing more.

I think if I had a take away from that time it would be to not try to time the next recession or buying window. Set up your systems and learn to operate in any type of market.

@Karen F. The number of children under 18 doesn't impact an eviction as they will be bound as a party to the execution or ejectment.

If there are tenants receiving a subsidy I would notify the voucher disburser of the violation. If you get a good case worker sometimes they can leverage compliance with threatening rescinding the voucher. The downside of this is the obvious scenario of losing the subsidized portion of the rent and still having the non-monetary default issue. Further, you need to investigate if the Kappa notice needs to be served on the voucher subsidy party, too. Superior court decisions are not consistent on the issue.

I don't know how many units you have but at some point you need to consider professional management or you are GOING to burn out given the current circumstances.

There is not a form. It is called a Kappa notice. You need to serve it with a marshal and then serve notice to quit if not resolved. I would not do this eviction as a self-represented individual. Hire a lawyer. You also need to weigh the costs/benefits of even going through a non-monetary eviction. The judges do not like them and you will not get much judicial leniency in the residential context (maybe more in commercial).

If I am taking on a flip project with a large scope of work, the first thing I do is send my partner or contractor down to the building department and find out what has been pulled and what hasn't. I then submit a new plan and ask what permits will be required. I find that the saying of "it's easier to ask for forgiveness than permission" does not apply to local building inspectors. The last thing you want is to update your electrical and have your walls drywalled and painted and the inspector ask you to open everything up.

If you are doing your own title search just for informational purposes to see what the legal description looks like or if there are other encumbrances of record then I would say sure go learn. However, if you are going to rely on your own search to make legal/business decisions I would caution you from doing that. You want a search to be done by a professional and backed up with a title policy from a title company or attorney. There are too many variables and standards of titles, and mistakes that can occur.

We use Buildium and our own website we built and maintain. We are able to have our available rentals automatically link from Buildium to our own website by just doing the work once. I would call their support staff and see if they can walk you through it.

I am in favor of the FHA 203K from an investment perspective but I don't think FHA should operate in this realm from a policy perspective. It is essentially creating a structure of privatized gains and subsidized losses. Leave this arena to the private market.
