I've listened in the last two weeks to several HMLenders' claims that no license is needed to refer commercial borrowers to them.

And from their veiwpoint, of course we don't need a license to make the referral!

But can the referral fee contract be enforced, to collect the front end point, and backend equity share payout offered, after the bridge loan balloons or is paid off early?

Anyone, attorneys especially, tried enforcing a HML referral fee contract, since passage of the SAFE Act?

Or does the SAFE Act have an exemption for those only making referrals, and not originating the commercial loans?

For those who've used Ben Pargman's short sale negotiation service,
-was he able to close deals submitted
-what is the average time from submitting completed paperwork, to closing

-would you recommend working with them, or have you found a better service for handling the short sale negotiations?

Has anyone partnered with Rick Wheat & Jeff Kaller in their “Making the Shift Into Commercial Deals†Boot Camp?

If so, what were the terms/percentages of the partnerships [he doesn't state the percentage in his marketing materials]?

What did you think of his due diligence team and deal funding?

Lastly, what was the turn around time for his team to notify you if they wanted to partner on the deal or not?

Does anyone have experience they can share selling natural gas drilling rights in the last five-ten years, e.g. during the somewhat similar Louisiana rush last decade?

Especially interested in:

a. formulas to determine whether we're receiving fair offers [are most contracts really set on a monthly basis royalty, rather than outright payment for drilling rights for the 20 year period - and is 20 years really the industry standard? ]

b. do drilling companies JV, i.e. we take lower upfront during the exploration stage, for a larger percentage later, or will pushing for that kill the deal?

c. if the drilling turns out not to produce the revenue anticipated, and the drilling company shuts down drilling, can the land be safely converted to residential development [land is an hour outside a top 10 fast growth area]?

Also recommendations for any reputable companies land owners have worked with, that behaved honorably after the leases were signed, would be appreciated.
