Thanks Marcia and Andrea. The lease was set to expire on march 31, it would become month-to-month if no new contract is signed, and the lease doss require 30 day notice by either party who likes to terminate the tenancy. On march 5, I got a reference call. I then talked to the tenant about the situation, and argued that she doesn't have to let me know or give any written notice. I later write an email asking her to reply and confirm her date and set up move out inspection time, but nothing happens. A couple more phone calls attempt to make the move out process smoother and hopefully no damages to the property, but the tenant would not let me know when the good time to do inspection. Finally, on 31st the tenant calls me and asks if I could meet and do inspection. I kindly ask them that I'll do within 48 hours. At this time, since I lost a month worth of time that I couldn't list the property for rent while the tenant is there, and seems to break the 30-day policy, I m curious if I am entitled to some of the security deposit for this particular reason other than damages, etc. in the mean time, I'll definitely look into the laws as suggested by Marcia. Thanks.

Hi all, I am still relatively new to BP, and have a question. Any input/suggestion is greatly appreciated. I have tenant that move out but didn't give me 30 day notice. I was fortunate enough to find out about it when a prospective landlord call me up. I am in Virginia and not sure how much of the security deposit I get to deduct? Thanks in advance.
