In Washington we have similiar laws. However we also have a law that states that we must provide an accounting of the security deposit funds and refund (if applicable) within 30 days.

Solution: Create the security deposit move out form. Add charges for rent for the remaining months, estimated utilities, estimated cleaning and repairs and cost to re-rent (in our case: cost to PM is 1/2 a month's rent). Provide all of this and state that these are estimates and that the amount exceeds the deposit. Advise that you will update all documentation upon the unit re-renting. In the meantime work diligently to make the unit rent ready and advertise.

In our state (WA) the tenant is responsible for pest control (as long as it was pest free when you delivered it) for SFR and the landlord is responsible for multifamily.

Tenant providing access is ideal. If not try a keyless entry situation that allows you add a temp code that will expire after the work is completed.

Your wax ring failed and saturated the ceiling below and likely the subfloor of the upstairs unit. You will want to perform a proper dry out of all materials and replace as needed, treat the area and have the lid put back together of the downstairs unit.

If the new tenants are 18 or older they should apply, you should screen and complete the appropriate roommate addendum. Treat them like any other tenant. The proper roommate addendum should reflect you adding 2 new occupants and should include language as such:



the parties hereto agree as follows:
1. All legal rights pursuant to the Rental Agreement, including return of any Damage or Security Deposit(s) are assigned to the Incoming Resident and remaining residents. Any apportionment of such deposits, or of prepaid rents, between Incoming Resident and Departing Resident or
remaining residents are solely to be resolved between them and Landlord has no responsibility for such apportionment. At the end of tenancy,
any amount owed will be the obligation of remaining residents; any amount refunded will be returned via one check payable to all remaining
residents.
2. In consideration of Owner/Agent’s acceptance of Incoming Resident, Incoming Resident hereby verifies receipt of copies of all rental agreements, addenda and notices to resident (such as Lead Paint Disclosure Notices, Property Condition Reports, etc.). Incoming Resident
recognizes that he/she is entering into an agreement which is retroactive to the original date of the Agreement. Incoming Resident further
recognizes that any refunds of deposits will be made subject to the original Property Condition Report between Owner/Agent and original
parties to the agreement.
3. Nothing herein shall be construed to imply that Owner/Agent will consent to any future change in residents.
4. Except as set forth herein, all terms and conditions of the Rental/Lease Agreement remain in full force and effect without amendment. Receipt
of a true copy of this addendum signed by all parties is hereby acknowledged.
In addition to the Departing Resident and Incoming Resident, this Addendum must be signed by all legal occupants of the Rental Unit.

In our state (Washington) you must send the lease non renewals 60 days in advance and they have to be served (posted at house and mailed). We do however also send it electronically.

I believe best practice is to have them make the security deposit payment within 24 hours. The 1st month rent needs to then be paid 72 hours prior to lease start date.

Small claims court is great if you are both local. It is likely best to move on.

If mom is going to live there too, it is simple they are both on the lease. If mom is not going to live there she can be a co-signer, I would just suggest to make sure she can afford her current situation and this one.
