Thank you for the response.  This sounds like good advice.  I will hand deliver them a drafted letter with two months notice.  

Is there any chance they can say I am not leaving.  If so then what ?

I own a two family home in NYC that is fully occupied.  The tenants are excellent. 

I purchased this home 5 years back with the intention of completely remodeling it and moving in.  

All the plans are in place to get started this upcoming spring but I need to get rid of the tenants. They are on a month to month lease that is expired.  

In the past tenants would generally leave on their own after a few years. This is a first. 

So my question is what is the best way to essentially get rid of them. Is there any legal issues I should be aware of.

Extremely hard to answer. Depends on just about everything.  From material to permits and what your buildings department allows.  I am in the process of doing an addition in NYC. Add more than 200sq ft here you need a drywell. Architect says to budget 10-15k. His fee alone if 15k. With those fees and permits I am looking at 40k before I even buy a 2x4. The next question is what kind of materials you are using.  You can budget anywhere from $90-$300 a sq ft depending on materials.  Talk to people in your neigborhood that have done an addition. Talk to builder and GC's. They have a better feel for the local area prices. What I am looking to do they are saying between $175 and $200 a sq but it all depends. I am not trying to discourage you. Just sharing my experience.
