Hi BP,

I bought a commercial property with two other partners using my Checkbook LLC (Roth IRA). I contributed $100k and if I decide to do cash out refinance it'll be recourse loan, do I pay 10% penalty on 100k? Am I understanding this correctly? Thank you for your feedback!

While I wait to hear back from my plan provider, do you know If I can setup a new account and transfer fund for Roth Solo 401k? I believe the form I have to fill out from my provider is Form 5498. Is that correct?

Is the Roth conversion form different from 1099-R? If so, where can I get that form?

You’ve mentioned 1099-R will be provided by the plan provider. Are they filling out the form for me after I tell them how much I’ve converted?

I’m sorry for my novice questions but I always appreciate your prompt response.

Hello BP,

I have Solo 401k and I want to do in-plan rollover to Roth Solo 401k. End of the year is creeping up and I want to get this done. What is the step by step process? I understand you have to fill out 1099-R but which portion do I have to fill out? What is next after that?

Thank you all for your response  and I will check with accountant! Am I correct of understanding that there is no UDFI/UBTI on increase of property for refinancing or if we sell the property for profit? Just on the net rent income?
