Post: Historic Property and an Unsuspecting New Investor

Hello BP community! My name is Tinah, a brand new real estate investor in Worcester County, MA and I ran into a few problems on my first transaction (details on a previous post). And, as if it that were not enough, a day before closing, I found out that the property in question is in the National Registry of Historic Places. This information was NOT provided by my realtor, this is news to me! I learned that there are restrictions in any updates to the front exterior of historic properties and this information would have been disclosed during the process.

I called the historic department and this is what I got. She said property owners do not have to disclose that their property is historic and they can perform any updates they want on the property unless they received a grant that would invoke the "preservation restriction."

I am a little confused - sellers do not have to disclose this information? Wouldn't this be relevant for buyers to know? It's kind of a big deal since these properties generally involve more work, planning and expense, it seems. For newbies like me especially, we can not ask what we do not know.

Additional questions would be:

How does a savvy investor catch this piece of information early on? 

Would you rely on your realtor to pick this up for you during due diligence? 

What would you do if your realtor misses it? 

And last but not least - How would you re/negotiate such properties so in the end it will cashflow despite the foreseen expenses?

Thank you Colleen. It's something to think about. It could have been a good deal if I were experienced and I had a good team behind me. I think it will be prudent to just walk away.

Thank you @Jay Hinrichs for saying that. Not really quite understanding everything that is happening on this deal.

@Tushar P. last time I called  my closing lawyer was to discuss what options I had if I back out of the deal. He essentially told me "You have buyer's remorse. I can not help you. You have no business making offers if you can't deal with lead in the property."

Not sure if he discharged me as his client because he has done nothing when everything imploded. Although, the seller's lawyer mentioned him yesterday and this part is bizarre - can't quite wrap my head around what it actually means. 

He stated " (Name of my closing lawyer) and I will have someone at Registry of Deeds on Wednesday ready to tender and perform. Will have buyers called on intercom and will sign appropriate affidavits to show sellers' performance. And will refer case to (name of another lawyer) for litigation and collection of liquidated damages."

I get the litigation part, I do not understand everything else before that.

My deposit is 4 to 5% of the purchase price. 

Thank you for saying that my lender should not be speaking with anyone but me, that's a great point. 

I think they know that. They also know that I am new in this space and this is my first transaction as an investor. They know that my realtor and lawyer have no interest in watching my back. It seems they are trying to bully me into buying this property as is.
