Spoke with my bank today about financing my next real estate purchase. 

On my credit report was an apartment complex where I broke the lease but paid all early term fees. I have all information saved luckily 

on Feb 22 I sent an email the the debt collector, they stated that if the information checks out they would stop with collection proceedings. On Feb 24 they submitted to my credit report, and each month since. 

Today I called and they said the account was submitted by error from the Apartment complex and closed out on their end but the debt collector cannot remove it from my report. Only the apartment complex can,  the apartment complex will not return my calls. 

Im selling a home now that I hoped to roll the proceeds into a 1031 but everything is in limbo now because my bank may either kill the deal or charge much higher interest rates due to this error and lower than expect credit score. 

I just found all this out today so Im asking for any advice how to handle this quickly considering I have all the proof I need. Its my understanding that disputing the credit agencies can take up to 30 days so I plan to do that asap. Ill email the Apartment complex tomorrow to start a paper trail. 

If my 1031 gets cancelled due to me not being able to attain financing then there must be damages to me financially? Should I start speaking with attorneys?

Sorry for the wordy post. I tried to keep it as simple as possible without leaving out to much info.

Thanks Bruce. This is what I expected to have to do but wanted to check with the more experienced folks here first. 

Need some advice. 

I needed to get my foundation and sewer line repaired. Since the home had Kitec plumbing in it I went ahead and had that replaced since the water lines were damaged during the tunneling for the sewer line replacement

Work was completed. Foundation permit passed and is closed. 

Plumbing Inspector came out and failed the plumbers for some work they did and also dinged me on simple repairs/updates I was doing in the house. Simple as in new paint, appliance replacement, light fixture replacement, and sheetrock (due to repipe of old Kitec). He was considering my house a remodel even though I stated everything in the home is original and that I was only repairing damage from the foundation and making some minor updates

He required that I get an electrical permit for 5 new lights I had an electrician run for me. Then he proceeded to walk through the home and point out reasons why he would not pass my plumbing inspection, nothing to do with plumbing btw.

I've jumped through his hoops fixed what he's pointed out and got the electrical permit pulled and got a passing electrical inspection. Plumbing inspector came back out and said he will not fail me but is only requiring the Engineering Report for the foundation which me and my plumbers have supplied him. We also pointed him to the passing foundation permit from February.  Now he is unresponsive and my plumbing final sits as pending. Both me and my plumbers have reached out but he will not return our calls. 

What avenues do I have left to get this permit passed? Submit for a new final plumbing inspection? Call his supervisor? I am putting the home on the market next week and do not want to sell this house with permits that are pending.

My rental in Del Valle needed its foundation leveled. After leveling the home the hydrostatic test failed. Plumbers recommended the sewer line be replaced. 

Hired the foundation company to tunnel under the home to expose the sewer line. The guys doing the tunneling then punctured the main water line in several spots. 

Plumber comes back out and found the main water line and all pipes throughout the home was Kitec so now I have to repipe my entire house. 

Right now my concern is to get the home livable again but am curious if the foundation company that did the tunneling is liable at all since it was Kitec and needed to replaced anyways. The pipes were in perfect working order before but almost feel like this event has saved me something bigger down the road. Whats yalls thoughts? 

@Jacob PereiraI I have but my county keeps extending the moratorium, although this time it expires on May 1 we expect them to line up with CDCs June 31 expiration date and slowly implement evictions slowly starting July 1, I have a feeling my tenant will live rent free the remainder of the year. No public entity is willing to help, lawyer is handcuffed, so im just eating this monthly loss. Tough lesson learned

Just wondering if there are any groups of angry landlords that are talking about how their tenants just stopped paying rent and have not been impacted by Covid, and cannot be evicted. I've searched around but can find any. 

Since I appeared to have run out of options, which there were not many  I am online hoping to vent. Thanks

@Nathan G. Thanks for the reply. I did not mention that my lawyer did send her a copy of the guidelines plus verified I did not receive a CDC affidavit from the tenant. Things like this is why I hired him, to help me navigate the covid legal system

I have an email stating she was looking into rental assistance but after that all comms stopped. My lawyer took over. Calls, emails, letters and the tenant still hasnt even attempted to work things out.

Im worried the tenant will destroy my house on their way out but its a hard lesson learned but am determined to keep the property and continue landlording.

Got the eviction trial set for this month. Was able to show multiple lease violations. Since I dont have an FHA loan allowed me to proceed

If you have a tenant taking advantage of the stupid eviction moratoriums you have options. My lawyer was invaluable and got a court date within 14 days of hiring him.

I still got a ways to go but looking forward to putting this BS behind me.

@Bruce Lynn I certainly do not but that will be in my next lease. I knew I would have to go through this one day so I am learning a lot. 

Currently the moratorium in Austin/Travis county prevents even sending notices of eviction until 4/1, that will most likely be extended

The wheels are in motion now. I just sent my attorney permission to start the process, get the info he needs, and evict as soon as he possibly can.
