We're looking to do a 1031 exchange of our two rental properties and buy a vacation / rental home in the OBX. I found a lovely ocean front home in Salvo. My agent who lives in NC recommends to look North because of the erosion. Thoughts about properties south of Nag's Head?

Tenant complaint issues...

Tenant A which is residential and has a couple of kids. Tenant B which is commercial and in the basement. Tenant A complained that Tenant B would blast their music and the subwoofer is really loud late at night. Tenant B complains that they hear kids running around all the time.

I decided to post a notice to all tenants that there is a noise ordinance and that tenants may not interfere with the peaceful enjoyment of the neighbors. Tenant B keeps on complaining about Tenant A. I did call and notify A to be respectful and mindful of their neighbors.

Honestly, I believe it's a case of "he said", and "she said".

My personal opinion, tenant B is a younger kid who runs a tattoo shop and thinks that he can blast music and drink freely. Just because you own a "business" doesn't mean you can party late at night.

Tenant A is a family with young kids. They're ok, but kids are kids. The times I've gone into the apartment, they seem to be ok.

I'm not sure how to deal with each one complaining about one another. They both pay rent on time. I'd hate for one of the tenants to complain that I, the landlord haven't done anything when in reality, I don't think there's much that I can do. I've reiterated that neighbors have to respect one another.

Thoughts?

Plumber thinks its the commercial unit since its paper towels and its one of two units on the first floor when he snaked it. Tenant from the commercial space says the floor is ruined. Who's responsible? Id figure if they are part responsible they should pay for it?

I have a 7 unit with two commercial spaces. There was a complaint that there was a backup and I had it snaked a couple of times and the plumber found rags. I sent out a notice to all of the tenants not to flush paper towels, rags, feminine products and that sort. Fast forward 4 months and it looks like it happened again. I'm not able to determine who is the culprit in putting items down the drain. It's very costly to get someone to come out and snake the system. Is there any way I can get everybody to pay the bill or what have people done in their experience? Thanks

Thanks for the feedback. No, I havent confirmee, but the groundskeeper said there was a notice of disconnect. Whats the likelihood of a bad meter or an issue between the meter and disconnect?

Im assuming ill be responsible for any repairs?

Hello all, I hope I can get some advice or guidance about an issue...

I bought a 10 unit property last year which included two commercial spots. The one commercial tenant had requested items to be addressed to the previous owner which werent fixed until I took over. Small items such as ceiling fans and AC unit not working.

Fast forward to the issue today...The tenant complained to the electric company that their bill is high. They requested to have their power shut off since theyre closed for the summer. They found thay there was usage on their meter while their space was closed.When they are there once a week, they state its about 20kWh per day. They stated when the power was off, there was a usage about 16-18kwh per day. 

I assumed that the electric company wouldve had all of the units routed to the appropriate meters. She says I would be responsible 100%.

Is there anything I can do to do an audit?

Am I liable for back charges? There was no wrong doing as I wasnt aware of this issue?

Any thoughts or opinions would be greatly appreciated.

Yes, he'll be moving his own items out.

Yes, I just reread the notes. It looks like If the tenant does not move out within 10 days of the judgement, I have to request an order of possession.

After the judgement, the judge says I still have the option to "work it out" with them. I know it sounds pretty general. The friend did call me to say the tenant will be coming out of rehab to grab their items and move out. I would assume our "working it out" is to end the lease agreement. 

Also, @Justin K. has the clause for abandonment to by pass eviction upholdable in the courts? I have seen other landlords do the same, but I just sounds to easy to have them agree to by pass a state requirement for eviction?

I did meet with a lawyer earlier this year for an eviction and asked about the clause to bypass the eviction process. I didn't really get a clear answer either. It was kind of a yes and no answer.

Hello all..

I have two eviction scenarios. I know you guys can't provide legal advice. I'm just looking to see what others have done.

1) The first tenant is in rehab and I followed the Notice to quit, had the hearing and the judge ruled in my favor. I have to wait the 10 days in PA to get a sheriff for the lock out. The tenant's friend told me they will move their items out for them since they are in rehab. Do I still have to get a lockout by the sheriff, even though they are moving out? I was questioning this because the sheriff will "transfer the property" back to me, correct?

2) Second tenant in a different property wants to move out. I told them they actually would have to wait until September because they signed a year lease. They haven't paid this months rent (15 days late). I'm assuming they're probably going to up and leave. Would I have to proceed with the eviction process and hearing even if they up and leave?
