Yes there are 2 side to every story. But wrong is wrong and I will reach out to seek an attorney for advice.
But here is some background info on this whole situation. I am military 24 years transferred from San Diego, California to Honolulu, Hawaii with all my household goods of 14,000 pounds. I have moved all over the world and never have had this type of situation or problems with and owner or landlord.
So I signed my lease on 01 June 2018 for a year and before I moved in I talked with owner stating that I needed a long term lease up to 3 years due to my tour length he said no problem. There was a military couple in unit right before I moved in for 3 1/2 years so the owner said understood.
So the military moved all my household goods in unit and unpacked it after they arrived on island and I found a house. Fast forward to 30 September 2018. The owner called and left me a voicemail message about selling his house. And I was like what? So I called the owner to find out what was going on and he said he had to short sell because his interest rate would go up 01 January 2019. He stated in order to keep the same interest rate he needed to put down $150,000.00 and he did not have that type of money. So if he did not sell by 01 December he would have to foreclose. He told me he owed it to me to let me know because we did have a good landlord/tenant relationship. He did tell me "they" did not want me to tell you but he knew in August 2018 about his interest rate going up. I asked him who was they but he would not tell me. So this is just my opinion if you he knew in August then there is no why he could have not known on June 1, 2018 when I sign the lease that about the interest rate. And course I was upset and who won’t be.
So the owner stated his agent he hired from this well known company and will not mention anything names of individuals or real estate company would be calling me to come by and take the condition of the house so it could be placed on the market.
His agent came to the house 01 Oct 2018 to take condition of house. Agent told me that if there was a buyer, they would have to honor my lease because by law of Hawaii if there is a sign lease with per-determined dates and sign by owner/landlord and tenant the buyer shall honor lease. The house went on market 03 Oct 2018. I received a phone call from agent on 06 Oct 2018 state that there was a buyer and the house was in escrow and I said ok that was fast.
Then the agent stated to me that owner says I didn't have to pay 01 Nov 2018 rent. I said to her wait a minute what is going on....... She then said the owner told her to tell me not to pay 01 Nov 2018 rent and he is going to give me $2,000 moving cost. The agent and owner told me via email that I need to move by the end of Oct 2018 because the buyers will be taking occupancy of the home 01 Nov 2018. I told the agent absolute not I will not be moving by the end of Oct 2018 and I will be paying my rent for Nov 2018 and so on. I then gave the owner a call and sent a follow up email stating that I would be paying my rent for 01 Nov 2018 and will not be accepting $2,000 for move cost. It would cost well over $2,000 to move my household goods. The owner told me that didn't have to give me my security deposit back. So things starting going south from then.
So 2 weeks later the owner sent me an email stating that he needed to hear from me within that week if I was willing to move out by the end of Nov 2018 because if not the buyer's will be suing him for breach of contract. I did email him back to let him know that I don't know what was told to the buyers or what deal was made or disclosed. I never agree or signed anything to move out of the house by a certain date or time other then what my lease stated and that is something you need to work out with your agent.
So there was a house appraisal and house inspection done. So the buyers dropped out contract because the agent texted me so very unprofessional text about it. So now when more showing request started coming in the agent was just very rude and disrespectful at times. If I had something going on at the time I would always give her an alternate time or next day to show. Which she was very irritated by it so you would started texting me all hours of the day and night for showing i.e from the morning to 5pm, 7pm. 10 pm , 12am, 1 am, 2am in the wee hours of the morning. I let her know the it was unprofessional of her to be texting me all hours of the night and I know she has hours. She then text back stating she work 24/7.
So the harassment and threats of texts, emails and voicemails begin with her and the owner because I would not comply with their demands on moving out and with the less then 24 hour showing requests. And of course I have be looking for a place I want to move to and not any place they want to stick me at because they want to hurry and get me out the house. So fast forward to the present. There is no sitting down with the owner/landlord at this point.
