Go to the website of the Arizona Corporation Commission and do a search.

While there is no guaranty the LLC is registered in Arizona, if it's an LLC that is owning income producing property in Arizona, there's a good chance it will be registered in Arizona (at least it's supposed to be registered in Arizona).

Looking at the site may or may not give you the information you are seeking, but it's definitely the place to start.

@Greg Larson - @Jessica Zolotorofe is 100% correct. Get your agreement signed now. First, you want to be protected and have your agreement in place. Also, if you are sending the deal out to your buyer's list, this is the time when you have the most negotiation strength.

I would get your deal worked out now and get it in writing ASAP.

My father had a rental house he sold some 25 years ago, with Seller financing.

I wound up having to take the property back, as the buyer defaulted on the loan.

When I went there, I saw that a tenant who had lived in the property for the past 45 years was still there.

She used to pay her rent weekly and I collected rent from her personally countless times when I was growing up.

She tried to hand me her money and I refused to take it.

I told her that she'd paid rent there for 45+ years and I didn't want her money. She'd already paid enough.

Now I realize that's not a normal situation and we were talking may $100 per week.

All I know is that $100 meant a heck of a lot more to her than it did to me.

@Erik Gardea Generally, you have to file a tax return and pay any taxes that are due. If they overwithheld, then you can get that amount back.

As you suggested in your original post, you need to hire a CPA or tax attorney to walk you through the process. I recommend you hire a local one, as there might be state tax issues as well.

@Kiah Davis While I'm sure there are a lot more details to the situation, what you are describing might constitute fraud on the part of the person doing the title search. Were they an employee of the title company?

You definitely need to talk with an attorney with real estate litigation experience on this one.

@David Petikyan I do NOT advise going around your broker. Either get your broker's permission to do what you are planning or get a different broker. And yes, you still need to disclose that you, as a principal, are a licensed real estate agent.
