Great investment opportunity in Knoxville, TN. Seller has enjoyed years of cash flow from this property but the tenant recently vacated and seller wants to cash out. The previous renter was paying $650/mo. 

The original hardwood floors are solid but need to be refinished. The roof is only 3 years old, HVAC is only 2 years old, and new vinyl siding and windows were installed 8 years ago. Lead plumbing was recently replaced as well. The kitchen and bath could use some updating. This home is conveniently located and sits on a level lot with a deep back yard and a large shade tree.

Congrats on getting your license @Matt Horton! I think your questions are spot on. In addition to the fees and commission split, I would definitely focus on the training they offer and the technology they provide. At my office, there are typically two to four classes offered every weekday, taught by some of the top agents in our market center. That training has helped me immensely.

In Tennessee, an agent is required to disclose personal interest before a contract is signed.

Tenn. Code Ann. §62-13-403(7)(A) provides that “a licensee shall not engage in self-dealing nor act on behalf of a licensee’s immediate family, or on behalf of any other individual, organization or business entity in which the licensee has a personal interest without prior disclosure of such interest and the timely written consent of all parties to the transaction.”

I think you could make the argument that if the agent financed the property for the seller, then he would have a personal interest in the sale of it. However, just because he has a personal interest, it doesn't mean there is a conflict or any wrongdoing. You should have been issued a personal interest disclosure form prior to signing the contract though.

If they allowed the "I made a mistake" excuse, just imagine how many contracts would be voided after signing. A seller could receive a higher offer 6 hours after signing and then say oops I signed that first offer by mistake. I think you've got a valid, executed contract. However, from the sound of it, you may be forced to take legal action to enforce it. I'm not an attorney but that's my take on it.

Post: Issue removing pictures of my property

I'm a real estate agent, not an attorney, so I can't cite any privacy laws here but I can tell you what our local MLS has told its members about this issue. The reason our local MLS keeps old photos is so real estate professionals can research previous sales. According to the MLS, the legal issue is that those pictures are technically not pictures of your property. They are pictures of the previous owner's property and the previous owner gave written permission to have those pictures posted on the MLS. You may now own that same property, but it wasn't your property on the date the photos were taken. Even when people have threatened the MLS with legal action, they still decline to remove old photos because they know they have legal authorization to display them. I know it stinks when anyone can pull up a website and peek inside your home but I'm not sure there is anything you can do about it. Maybe an attorney can offer more advice.
