Thanks a lot Joel! I figured I would be wasting my time going after the security deposit especially since she filed bankruptcy. I have been working with the Real Estate Commission regarding my case and they informed me that I would have to hire an attorney to get the Automatic Stay lifted. The Meeting of Creditors is 9/27/2012. Do you think it would be a good idea for me to speak with the Bankruptcy Trustee?

I filed a small claim suit against the property manager regarding my security deposit. I received a notice of court action saying disposed by separate order. Then I received a letter saying she filed bankruptcy. So my next move would be to file a motion to lift the automatic stay... right?

I moved out the minute I found out the house went into foreclosure. I then waited 35 days and ask for my security deposit. When I did not hear from the property manager I filed a small claim suit. She in turn filed bankruptcy. From my understanding the property manager stole all the tenants security deposits and the owners money of the property she was managing.

Thank you! The property manager stole the all the tenants security deposits and the owners of the property money. She has several lawsuits pending against her. She has also turned in her real estate license. I live in Montgomery, AL and all this is so confusing and time consuming.

I was a tenant where the property manager did not inform me that the house I was renting went into foreclosure. I asked on several occasions for my security deposit to be returned. I filed a small claims suit against her and a month later I received a statement saying she filed bankruptcy. However, the security deposit is not listed as a debt on the bankruptcy paper. I want to know can I file a motion to lift the automatic stay without an attorney? If so, do I have to pay to file the motion? Will I ever see my security deposit again?
