 True! Anytime I don't have to evict someone, that's a win.

As far as the record goes, you can search the County Recorder for death certificates. So I'd give that a quick try before asking the tenant for it just to try and avoid asking. If I can't find it in a 15 min search at the recorder, then I would go ahead and ask. 

As far as the SD, disperse it as usual...apply any damages and refund the remainder. Depending on the lease and receiving the death certificate send the check to either "the estate of XXX" or if Dad was also on as a financially responsible party I'd make it out to "Dad, or the Estate of XXX" so he could deposit it himself. 


 Searched the County Recorder and the Coroner's Office but couldn't find anything (even in neighboring counties). I hadn't thought about who to make the refund check out to, thanks so much for that!

That's what I would normally do, but it depends on how long he's been a tenant, how good he was, and other factors.


 Overall they were good tenants, never late on payments, etc. I feel for the guy and the terrible situation he is in. Thanks for the reply!

 If they were long term I would let them break the lease and if the home was left in good condition then I would return the deposit - now this is just me but you have  alease that dictates specific terms that you can uphold them too or not.

It would be ok to ask for the death certificate, and what you could say is its our policy to waive the fee for death but we need a record of it.


Thanks for the reply. It helps me to feel more confident in allowing the termination and waiving the fee. I try to put myself in his shoes and just feel terrible about the situation. Thanks again.

Before passing, the son scheduled the next month's payment but it hasn't deposited yet (it should in a couple of days). Hello,

I am looking for a real estate attorney who can look over my long term rental lease agreement. I grabbed a template online and have made edits to it based on info I've read here in the forums or listened to in the BP podcasts. The tenants and I have already signed it but I want to make sure I didn't miss anything for next time. I also need to ask them what the protocol is when tenants are late on their rent payment. Do I have to mail, email or post a notice and what should it say? It hasn't happened yet, but I want to be prepared. Please send me your referrals. Thank you!

Check the recorder of deeds office, not the tax assessor 

 Thanks for pointing me in the right direction. I called the Clerk Recorder and the only option they have is to search by owner name (which I don't have). They referred me back to the County Assessor so I called them. They clarified that the only way to obtain this information is by coming in person to the public service counter and using the kiosk or by sending a written request by mail (takes about a week to receive a response). 

Seems like an antiquated process but, oh well. I'll be visit the public counter often.

Hello, how can I look up the name & address of a property owner in Orange County, CA? I've been driving for dollars and have compiled a list of potential properties. However, when I go to the ocgov website and look up the property tax records, the owner name and address are replaced with this message: ASSESSEE NAME AND ADDRESS ARE NOT AVAILABLE ONLINE PER CA GOV CODE §6254.21. 

I can probably ask my real estate agent but she's so busy, I don't want to give her more work that might lead to nowhere. I'd like to be able to look it up myself. Thanks!
