Post: Roots in the Sump Pump

So I've heard of roots getting into the plumbing and pipes, but this is the first I've seen where the roots have intruded into the Sump Pump.

Sump pump still runs and turns on but we can clearly see the roots in there. 

I've asked two different plumbers and they said either to replace the whole thing or just kill and clean the roots out through a variety of methods.

Who else has seen or had this, and what did you end up doing?

U.S. District Court Judge Dabney L. Friedrich of the District of Columbia struck down a nationwide eviction moratorium Wednesday, calling it unlawful. Friedrich's ruling applies nationwide, though the Department of Justice has appealed the decision.

The eviction ban was put in place last year by the Trump administration using public health powers granted to the Centers for Disease Control & Prevention during health emergencies.

The ban was most recently extended by President Biden through the end of June.

In her 20-page ruling, Friedrich said, “It is the role of the political branches, and not the courts, to assess the merits of policy measures designed to combat the spread of disease, even during a global pandemic. The question for the Court is a narrow one: Does the Public Health Service Act grant the CDC the legal authority to impose a nationwide eviction moratorium? It does not.”

The Georgia and Alabama Association of REALTORS®, two housing providers, and their property management companies, filed the suit in defense of mom-and-pop property owners around the country struggling to pay bills without rental income for more than a year.

NAR—which helped secure nearly $50 billion in rental assistance provided by Congress since December to help tenants pay their bills and provide relief to housing providers who have lost income—supported the lawsuit, saying the ban was no longer needed.

"NAR has always maintained that the best solution for all parties was rental assistance to cover the rent, taxes and utility bills for tenants struggling during the pandemic," says NAR President Charlie Oppler. "This decision prevents two crises—one for tenants, and one for mom-and-pop housing providers who do not have a reprieve from their bills. With rental assistance secured, the economy growing, and unemployment rates falling, there is no need to continue a blanket, nationwide eviction ban. With this safety net firmly in place, the market needs a return to normalcy and stability."

Oppler adds that “our attention now should turn to the swift and efficient implementation of rental assistance.”

Post: Sherwin Williams Paint Discount of 30% to 57%

I work with people all across the spectrum of real estate and I always get asked for painters and coupons, and I always have to go shopping with them for them to get my discount code because they aren't members of the group that I am where I get the discount code from.

And now that I found bigger pockets recently and have loved every minute of being part of the community, I want to share this with everyone and hope that this paint discount helps everyone out there!

Now here's the thing, you would have to pay for the discount, the organization that has the discount code costs $195 a year to be part of it, but all you have to do is the math, if you're saving 30% to 57% off your paint purchases and painting supplies then is that worth it?

It's only a discount for Sherwin Williams, so if you don't like them, they don't have a discount code for anyone else.

There's no minimum order you have to place in order to use the code, and it's a 30% to 57% discount. Why the large swing, because every paint company has different "levels" of paint, so it's based off of the level of paint you get.

But I've been part of this organization for years, and just the discounts alone are worth it.

Just received this update from the Colorado Association of Realtors and hopefully it is useful information. And if anyone else has any additional information regarding the bill or its impact I would love to learn more too.

Renter's Rights Bill Amended to Protect Property Owner Senate Bill 173 addresses the rights of tenants in residential lease agreements focusing on late rental payments and associated fees. 

The bill was discussed at length today on the Senate Floor where many amendments were made.

Many of the amendments came to fruition thanks to the Colorado Association of REALTORS® and our dedicated advocacy team who voiced the need to balance the relationship between the tenant and housing provider to protect housing affordability and keep new legislation consistent with existing landlord tenant laws. 

Amendments passed today:

L.020 - Exempts single-family property owners of 5 units or fewer from the bill. (Includes property that is managed by a management company and is consistent with HB20-1332 and HB19-1118.)

L.019 - Changes the grace period from 14 to 7 calendar days.

L.018/COW - Provides reciprocal relief to housing providers that must pay their mortgage and other financial obligations late due to late rental payment.

L.024 - Reinserts language that requires a tenant to show proof of earnest money up front to ensure nonpayment is not due to not having enough money.

L.023 - Requires the bill to take effect upon January 1, 2022 to allow time for housing providers and tenants to get up to speed on the new laws and changes.

L.016 - Clarifies when a defense can be raised related to proper notice.

L.014 - Reduces the minimum and maximum fine that can be charged to a housing provider that violates this bill and fails to remedy the violation in a timely manner from $500-$2,000 to $150-$1,000.L.013 - Increases the maximum fee that can be charged due to late payment from $20 to $50.

L.012 & L.025 - Reinserts language that removes requirements that would prevent a tenant from filing an appeal or warranty of habitability claim due to inability to pay to file appropriate documentation with the court.

L.011 - Requires the tenant receive a list of resources, including websites and phone numbers, to obtain civil legal aid and rental assistance upon receipt of a court order, and narrows the timeline so that a trial hearing would take place no sooner than 7 days, but no later than 10 days unless the court's docket is impacted by COVID-19.

In Show 28, the guest speaker Dave Van Horn talked about how since he is a licensed investor he is able to take unlimited amounts of deductions to help with his taxes, so I was wondering if someone could go a bit deeper on what he means by that?

I understand they talked about how much you can deduct from losses per unit, other write offs and expenses you can take, but what did he mean when he said on the show that because I am licensed, it opens it up for me to take as much as I want in losses/deductions?
