okay thanks. i don't want to get in any debt. and figured if i subject to the foreclosure would go on my name. or the seller could sue me. I was thinking to get it and sell for 170k "As is"and buyer pay closing on a cash deal. but like you say that is risky with the 21 days coming fast.

I have heard of people giving the deed away. like a subject to.

yes the house does have equity. right around 40k

the loan is for 146k they are in default 12k

the comps i the area is 192k-203k

they said they tried to get a equity cash out but there credit dropped from a unpaid loan they took and could not refi. and they waited to long for a loan mod.

okay so i meet a owner yesterday in the notice of sale stage from the default. The auction is in 21 days. what can i do with this because they are willing to do anything to avoid foreclosure . they say that they can save it if they pay the default amount.

does anyone know if i can even sale this house?

and can it be put under a "subject to" contract or a give me the deed type of thing?

okay i understand. its a code of ethics and respect. will the listing agent make your offer to the seller? i seen one thats been on the mls for almost 6 months.

Do you have to deal with an agent or could you make your offer directly to the owner? Lets say I wanted to wholesale a house but it is already listed on the mls,can I do that? If so, how would i do that without buying the house first?
