what should i put in affidavit or how should i go about writing it? i'm not an attorney so i don't know how to prepare that? any example you can show would help. thanks!

Should I give them a receipt at all times or should I give if they ask for it? Tenant is paying by cash. I have a tenant that recently signed lease that starts on the 1st of this month. After discussion back and forth prior to signing the lease with the agent that's what the agent tells me. Certain things we agreed upon was to deduct from the days they won't be able to move in and this is just for the first month of rent but going forward they will pay the amount agreed upon on the lease. 2000/31=64.5*7=451.5 but will say $452. They have already paid the deposit and we agreed to deduct 452 from the 2k rent just for the first month for the days they said they are not able to move in...They first said they are unable to move in until the 8th of this month but then I just got told that they might be able to move in one day earlier so they say they will pay us $65 for moving in earlier one day. 

So my question is if I were to write the receipt for this money they will be paying what is the proper way to write on the check under the receipt part...like the note section so there is no confusion? I want to keep it as simple and understandable but don't want to use bad wording on the receipt that doesn't apply.

Would this be correct or proper? But its too wordy...

Pro rate rent money for moving in on 12/7 (initially agreed upon for move in date 12/8) do u think that is fine?

We told the agent what our requirements are and then she probably did her own screening and if they think they qualified or meets our requirements then they will schedule a showing with the client...we ask for 1040 tax return from last year, most recent paychek from this year, all the people who will be living in the apartment their IDs...and ask check credit report (but most of them say they will provide us with that.

How are they going to move in a single day?  Most people need a couple days to pack, move, clean, etc.  There will likely be some overlap between leases, and that is not your problem.  They should plan accordingly.

The above first post I mention in it...this is an e-mail from my agent not sure if its all info forwarded to me from potential tenant or also could be that agent made some modifications to the email before sending it to me mentions the following:

" Tenant also mentions this request is because she really have the issue with current

landlord, and hope we guys can understand and do her a flavor just this

time, she loved your apartment very much and don't want to give us any

trouble.  "

So I should find out when they come sign the lease what issue they have with current landlord? is there an appropriate way to ask this or if i'm not sure just let the agent know and have them ask in person when they show up??

Looks like their last rental was their first...I am able to see through my cam that they were well dressed during the time I was at work...The couples don't have driver license but one has a learner permit that expired...their dad has a nice silver SUV that looks very new and clean... the second time they came to visit two person that didnt show up the first time came along with the person that previous showed up for the first showing...they didnt have any question to ask because my dad don't know much english and they just showed up to our house doorsteps and called the agent up to ask to go in and see the apartment...for the second time...they ask about when the lease start date will be and her husband just ask one question about whether the water is hot in this apartment...the potential tenant is 4 adults...  couple wife and husband and the wife's parents...

We already agreed with them through e-mail and told the agent but can we still changed this??? Since, the lease has not been officially signed that we will not deduct and give them the reason as to why....I suspect that they talked to their landlord and they will lose their deposit if they move out before a certain date...they mention december the 6th...but I also checked and see that they been living there since sept of year 2018 so its been more than a year of the lease....did they renew the lease and then decide that they want to move out or did they do month to month and then made some agreement with their landlord....regarding the return of their security deposit...

since they living at a small space they might not have too many things to move out and she mentions that she can't find a moving company during the holidays is weird....UHAUL operates on holidays unless she referring to private moving company...which can help them move all their stuff out in one day...

We have made it pretty cleared of all our requirements and agent has told them unless maybe she didn't or maybe she did but then the potential tenants just still didn't understand clearly or missing out. I've worked back and forth with agent communicating through email mostly since my parents don't understand much English and just told the agent any questions they have to just communicate through email with me. Then I provide my dad with the updates and if he has any questions or concerns he will usually call the agent and have a talk... My dad told the agent about all his requirements when they met in person...but the lease has not been signed yet while we were coming to an agreement. I thought it was the agent that will take care of all these for us regarding providing them with payment instructions?...This tenant was the first potential tenant family who viewed the house and was able to provide all documentations we requested, they are a total of 4 adults, it's a couple. The other two adults are the wife's parents, they are both retired. I was not home when my Dad and agent met them, agents say they have good stable income, and seems like very nice people.

Only the couple provided their last 2 Paychecks, Photocopy of all their IDs (which all passports were provided), tax returns which was just an estimate planner for year 2019 so we requested to see tax return of 2018 which they provided but the screenshot was so blurry however was still able to analyzed the numbers, and compare it to the numbers on their recent paychek.

The credit report they say that they will send it to us later...When they did they only send us the credit scores then we ask to see the full report not credit score and they provided it. Both was 620 range...the couple wife had a good score in 780 range but these last three months it went down 150 + points and the card for the late payment is a credit card from a clothing department store that she probably spent and forgot to pay...but looks like the card account has been closed off too...all other credit card account she has payment was paid in time...The couple husband the report shows that he has just been making minimum payments each month and not the full payment...I don't know why....

I'm also wondering why the parents are living with them...we also requested credit report for their parents but their daughter is saying their family's parents just came from overseas, they don't use credit cards so they don't have credit reports... Is this true? I was able to find some more info about their parents and I know some stuff her daughter are saying is not true...and not being honest...but my dad was like sometimes they just wont want to tell you the whole true story of certain things but also i understand that certain things depending on what it is you must be honest or you can DQ them from the rental app?... 

Should I have asked them to see any documentations from her parents? Even if they are retired...also this just came in upon checking they both parents have lots of property deeds, own properties, businesses, property assessments, and 2 SSN(are you able to get two)?? And they are probably house flippers? I suspect that their parents are also living with them at this rental place the only place the young couple rented and says they want to move because they need more space... its probably a 1 bed room and they needed more space which was able to check that address and the place is half the space of my apartment...so their reason for moving is true...the address prior to that their parents owns a house which has been foreclosed last month...not sure why but my dad was able to go to check and says it has lots of violations on it with violations paper listed in front of door..


THe question about lead disclosure maybe her parents brought it up to her to have her ask..i wouldn't think they will ask that question unless you own some properties which the daughter also mentions that they don't own any properties and that their parents are here to live with them. Her parents seems very quiet and just let the daughter do all the questions asking...from what the agent and my dad was observing...

Should we have asked for any other verification documents so for next time I'll know better??? It's too late now if they are coming later to sign lease...


I never get to see them in person the two times they came to check the place...the second time they came they just called up our agent and the agent told my dad that they are in front of our house with two other people who the couple daughter brought her husband and mom who didnt show up the first time when the daughter came with the dad to the showing...


So i Never got to ask them or screen them in person all of them but I suspect the agent will pre-screened them in person before bringing them????

We also checked that all 4 adults have no evictions, criminal history, or bankruptcy...

Example: crack in the ceiling, electric, etc. What is the turnaround
time on these?

Any time you qualify an applicant and they agree to rent from you, there should be a clear understanding of when they will rent, how much they will pay, the terms of the lease, etc. They shouldn't be trying to negotiate things a couple days before move-in.

If the agreement was to start renting December 1st, that's the agreement. If they can't move in until the 7th, that's their problem. They can still pay rent starting December 1st.

Rent is always paid in advance. Always. If the don't know that, it's a clear sign that they've never rented before which indicates they are high-risk tenants. 

Why haven't you already provided them with payment instructions? As soon as their application is approved, you should require payment of the deposit to hold the rental for them. Without a deposit, you have no protection. They could have you hold it for two weeks, then change their minds the day of occupancy and you would be left with two weeks of lost rent and no tenant.

You should read a book on how to manage rentals. Do it today because you are about to get yourself in way over your head. The BP bookstore has a book on managing rentals or you can buy "Every Landlord's Legal Guide" by NOLO which is my personal favorite.

They are a young couple in mid 30s who recently got married not long ago about a year and said they are moving because they needed more space...this current address they have been living in was since Sept of 2018. Looks like also this address they are currently at now is their first rental... We told them that the repairs will be mentioned on the lease of whose responsible for what types of repairs...

The question about lead paint is fair as for repairs, they may have been in a place where repairs took a while or had a bad experience being charged.  Your response for repairs should be that you handle them; however, who pays for it depends on the situation.  If they broke it, they pay.

Depending on their age, they may simply be naive or if they are older (ie renting for a while)...I'd be cautious.

My parents have met them but I have yet to see them in person, because I'm always stuck at work during the time they came to see the apartment...They actually came twice to see the apartment...Its 4 adults, a husband and wife with their two parents. the first time they came only two out of 4 showed up (dad and her daughter), the daughter's husband and mom didn't show...I was not there or else I would had ask them or ask the agent why only two showed up...My parents barely speaks English so they will not be able to ask them. The parents (daughter's dad) my parents said he check and skim through the apartment and opened all the closet doors we had took quick look then went back downstairs because he was worried about his double parked car probably...The parents daughter really loved the place from what the agent was telling my dad...They ask all these 4 questions just a day before they confirmed to come in to sign the lease...I just don't know how many will be present when signing the lease...already said one will not be able to make it (the daughter's husband) since he works late. We initially told them another date to come in but they said they wont be able to make it on that date so we even let them pick and they chosen the date that they can make it but still not all is available to show up so do all....   and do all tenants or is it better to have all tenants living there to be present to sign the lease? can we have the ones the is present to sign it and when they move in have the one that is not there to sign by the move in date?

Have you met these people in person? Do you have any other interest? I get it's a hard time of year to fill a vacancy, but these potential tenants seem like they're going to be trouble and you'll be evicting them in a month or two, costing you even more money.

A tenant is very close to signing a lease and has confirmed a date to come in and we told them that all people that will living in apartment must be present and to bring all documentations and have them ready. they promise okay...then last second a day before signing they say that one can't make it because they work late and the time they agree to come was late in the afternoon...So is it required that all people on the lease be present to sign the lease and if one is not able to make it is there any red flags? Can we have the one that is not present to sign the lease once we see him or get a chance to when he/she moves in??

Scenario..

Tenant will come sign lease, receive keys and move in not on the initial date of Dec 5th mention on the lease but will move in December 12th instead,

The reason for moving in December 12th is because
1. They cannot find a moving company during holiday (Thanksgiving week).

2. During the holiday her current landlord is unable to go through her

current apartment to check her move out, current landlord can only come

after the holiday.

So the tenant will need to wait to get deposit from her current landlord, tenant will move

out of current landlord home by December 11th, because of this issue, Tenant

asked if we can reduce her December rent payment for at least 5 days,

example $2100 ÷ 31=around $67.3 per day, so if you can deduct her

December rent for around $275 to $325, (Tenant will still pay full $2100

deposit) for January and will continue paying full rent of $2100 and so

on for the upcoming months up to the terms of the lease.


Tenant also mentions this request is because she really have the issue with current

landlord, and hope we guys can understand and do her a flavor just this

time, she loved your apartment very much and don't want to give us any

trouble.

Is this a good request or will any of you guys agree on this or how will you guys go about on this request???
