Hi, 

I am renting an apartment with a month to month lease agreement that requires 30-day notice to terminate. I have moved out of the property due to an emergency health issue to live with my parents. I described my situation for my landlord in an email and asked to terminate the lease early.

He replied back with sympathy about my situation and wrote: "You may end the tenancy end of this week"

Therefore, I rushed to move out and dump all of my furnitures and house hold goods to meet this deadline which was Aug. 1st.

However, after I returned the key, the landlord is refusing to refund my security deposit because the lease agreement that I signed need 30-day notice to terminate the lease. I was wondering if the mutual agreement between landlord and tenant to terminate the lease early in email conversation has a legal binding to over-ride the 30-day notice requirement of the lease ?

My apartment was in Contra Costa County CA.

How can I enforce ? Should I withhold the rent ? Threaten to sue ? Don't let them to get in the house for showing ? 

That is my question... what is my legal rights to enforce ? 

My landlord wants to sell his house this summer while my lease will terminate in the end of the year. Before I renew the lease last year, I have added the following items as an amendment to the lease agreement so that we can live in this place with safety and comfort:

- 48 hr notice for showing on a few days during the week, no weekend and open house 

- no lockbox installed 

- no picture taken from our personal property (landlord has a set of pictures when the house was empty)

I was wondering what legal rights does tenant have to enforce this amendment since the landlord really don't want to pay attention to them.

@Tim Swierczek Thanks for your reply. I really appreciate if you can provide the reference. I did look at my lease and found nothing specific about early termination in case of sale. Moreover, the landlord did mention the MN laws allowed him to break the lease. He did not mention the lease has a specific term that let him break it.

My lease contract is just a typical lease that is done through Renters Warehouse. Does 3rd party leasing companies like Renters Warehouse typically add such a clause to terminate the lease on sale?

Renters Warehouse is not the property manager anymore and I am paying my rent directly to the landloard. 

I am renting a house in MN and my landlord notified me that he wants to sell his house. My lease will expire in 8 month. However my landlord told me that I have to vacate in 60 days since Minnesota laws allows to break the lease if landlord wants to sell the house with 60 days notice!

Is that true? 

I really can't move out until my lease expires. What do you recommend me to do?

Do you guys recommend me to add anything in the lease for new owner ? For example, new owner should not expect us to renovate the houser or do professional carpet cleaning. Previous owner should pass our security deposit to new owner and things like that.

I am renting a house that is going to be on sale soon. My lease will finish at the end of this month and I can move out or renew a 12 months lease while the house is on sale. My landlord will increase the rent 10% if I want to renew to make to house attractive for future landlord. 

I prefer to renew the lease since I have a newborn baby and my wife is still not fully recovered. I have found a good house to relocate but relocation for me is a big hassle. 

On the other hand I don't want real estate agents destroy my life by open house and showings. Therefore I am thinking to ask my landlord ask a few clauses in my renewal lease agreement to limit these disturbances. 

What do you guys recommend me to do? 

Can I limit to one open house in a month on Sunday afternoon?

Can I ask 48 hr notice for weekdays showing from 5-6pm ?

Can I refuse to let them take a picture of the house with my stuff for online listing? The landlord do have a pictures of empty house
