In order to withhold rent they need to have notified you in writing about any issues and allowed you seven days to rectify. In addition, if they withhold rent, it has to be placed with the registry of the court where the property is located. If they have not done those two items, there should be no reason why the courts will holdup the eviction. 

Not sure what the interior will look like, but hopefully you have photos of prior to occupancy, so that you will be able to claim against their security deposit, and a judgement for past due rents and any damages

Hi folks, A tenant moved into my brand new house and defaulted on two months rent within 3 months of moving in. After multiple promises of catching up on rent, they are now 3 months behind. Because they have 3 children, I waited, and have now finally filed for eviction. Now, they are contesting the eviction saying in their response to court that  I did not repair two issues because of which they are withholding rent. The issues being  1) inconsistencies in roof (dont know what this means)  2) a hole in the drywall behind stove in kitchen because of which there are spiders coming out of the wall and they had to kill two of them.

At this time, I am concerned that they will trash the house while leaving it. Is there a legal way to ensure they dont trash the place? Any experience you can share is appreciated as I am doing an eviction for the first time. This is a brand new house.

Hello,

I have a tenant who has been delinquent for most of the 3 months since they moved in. They eventually have paid so far, albeit late. For the month of August 2024, they are saying that they have hardship and want me to use the money they paid as security deposit (2X rent).

Legally, am I required to use security deposit towards rent when they are delinquent or can I move forward with eviction process?

I am looking for a good roofing company in Ocala. I need to replace roof for rental property. 

1) Any  recommendation for roofing company is appreciated.

2) Does anyone have experience in replacing shingle roof with metal roof. Does metal roof cause more heat in the house?

3) Is it cheaper to lay metal roof over shingle roof without removing shingles?

You should issue a master lease to the company, transfer all requirements & liability for the operations to them. This will create a situation where all you are responsible for is owning the property and the master tenant assumes responsibility for everything else.

@Sendil Thangavelu Definitely do your research. I worked for a company for 8 years in a home that was for developmentally disabled adult men. What the company didn’t say was that they were all sex offenders (mostly with kids) who couldn’t be convicted because of their handicap status.

These were mostly pretty high functioning offenders who just had slightly lower IQs and in some cases likely were just poor test takers in school.

This home is located close to an elementary school because technically the offenders aren’t convicted.

Just do your research.
