What I have failed to see in this discussion is any mention of the constitution. The responsibilities and rights that are awarded to the federal government are outlined rather specifically, and that is being trampled upon. The truth of the matter is, this nation is not a democracy but a constitutional republic. If it were a democracy, only what the majority of voters wanted would happen and there would be no need for an electoral college.

I have seen the argument a few times about other govt. agencies and how they are funded by via the fed via tax revenue. It is true that Medicaid and Medicare as well as the VA provide health benefits through this means. What is also clear is that although the quality of care via the VA is considered by most to be sufficient, the beauracracy and lengthy wait times to see anyone other than a general physician is mind blowing. As for Medicaid and Medicare, both of these systems are nearly bankrupt. When they completely go under, the financial system we have in place now will do well to survive. Alot of the reason for this is the abuses that take place by patients as well as physicians and the fear in almost every politician to bring up the need for reform. Basically, we are standing back waiting for the trainwreck to happen.

Make no mistake however, Medicaid and Medicare are socialistic systems. And they provide the evidence of where that leads. Without limiting care, raising taxes, assisting in (or forcing) the euthenasia of seniors, or actually forcing individuals to use the system as a temporary last resort (and thereby alienating voters) it is destined to fail. It has proven to us within our own borders that entitlement programs do not improve the drive and motivation of citizens, it kills it.

As for govt regulation, it is already in place. Regulations, laws and restrictions have led to many of the problems in the healthcare industry. Just as in real estate, whenever the govt takes a very active role things tumble soon thereafter. Insurance agencies claim that fraud and physician fees are what costs them the most. We know that fraud can be investigated, and it is when economically feasible. With the fees doctors/providers/hospitals charge, there is only so much that can be done and still keep the quality of physicians we have. The 2 doctors I know on a personal level both spend upwards of $32K per year in malpractice insurance. Between this cost, taxes, equipment/upkeep/maintanance, and employee costs, any doctor would have to charge very high fees just to make a modest living.

We all know that noone can be refused care. As Eddie pointed out, they already get care and we already fooot the bill for that. So the argument that this is the reason for healthcare reform is bogus. It is simply to provide more entitlement that will destroy the ingenuity and drive that built this nation to dominance in the first place.

As for the FBI, police depts, fire dept, etc. I have never seen a national fire dept. The national forest ranger service does have within itself a fire dept to fight blazes at any of the national forests, or to assist when forest fires are threatening to cause major property damage or casualties on any forest land. Police dept.s are funded by the local citizens. Every state also has a state police (highway patrol) that has jurisdiction on the roadways that encompasses the state. They are not limited to county or city boundaries as are local police. They also have some form or another of an SBI. This is the police wing of the state that gets involved in local matters only on a limited basis. These policing units are supposed to be funded by the state.
As for the FBI, they get involved when crimes either cross state lines (causing jurisdiction issues), threats of national security that exist within the borders of the nation, and in state matters upon request when the issues a local municipality are facing are beyond their capabilities to control or maintain. The national security aspect of the FBI as well as the jurisdiction during crimes that cross state lines are justified by the constitution.

When I say they are justified by the constitution, I need to clarify and state that the constitution gives those rights to the fed govt. Not that a judge interpreted it that way. The right to healthcare does not exist. It is not a right! Local police and fire dept.s are there to assist in the unalienable rights of life, liberty, and the pursuit of happiness. The costs associated with providing protection ( police) and support (fire dept.) cannot even remotely be compared to the costs of a govt run health plan.

The less fortunate have been brought up quite a bit also. It is usually treaded on softly as to how they ended up that way. While it is true some have started off with less than others, and we all can admit that some are in that position because of choices they have made, the truth is that many would rather live 'securely' with a job or succession of jobs during their lifetime than take the risks that are needed to actually become successful.

From what I have seen, everything that has been proposed by the govt during the past 18 months (at least that long) is equivalent to a new investor coming on this board; telling us how hard it is to be a real estate investor; it didnt work for them even though they tried everything that was suggested by the ones on here with experience; so therefore, all of those who have been successful through the risks they have taken need to pay that investor that didnt succeed ( with the most successful paying the most) the average amount earned by those that are successful. This would have to be based on the word of the investor-who-couldnt, because to question what they did or did not do would not only be detrimental to their self esteem but may also be racist/sexist/cold hearted/discriminatory by other means.

Just to chime in here for a sec. , according to Scripture ( since this is where some of this conversation has landed) the woman you use in your example should be helped. But nowhere in Scripture was anyone helped financially or through miracles where they were not also exposed to the Scripture and its principles.

There are verses, and chapters even, of Scripture that would support Jawsettes stance. However, regardless of whether she should be helped or not if it is done for the wrong reasons it may as well not be done.

As far as places in the Scripture where Jesus refused to help anyone, there is only one that comes to mind. It was conditional ( as all of His miracles were) on the woman showing faith. That is in Matt: 15:21-28.

As for the full answer to that question, it was hit upon in an earlier post. According to 2 Tim 3:16, all of Scripture is inspired by God. According to John 1: 1-5 & 14, Jesus and God are one in the same. Both were here at the creation of the universe. So everything the Bible says is from Jesus, including 2 Thes 3:10 where it is commanded that those that do not work do not eat.

But one of the greatest lessons taught by Jesus was through the fulfillment of the law in 2 ways. Not only had He never broken a commandment and was without sin, he fulfilled the spirit of the law. He didn't do things because He had to, but He did them in the spirit of love and charity and obedience. To do the right thing with the wrong intentions is still wrong.

Maybe I am being simplistic, but I try to look at any situation like this from all sides. When the roles are reversed, the issue would be largely avoided. In this case, as well as the Imus case, Duke lacrosse case, etc., the white person is immediately called a racist. 3 young men from a prestigious school had there education cut short by a false allegation that the media and self appointed black leaders ran with.
I am from NC, so the Duke case was all over every paper and all the local news shows as it progressed. What I find interesting though, is that in Raleigh (just down the street from Durham) a group of approximately 20 black men attacked a white family during a July 4th cookout this year. They were reported as yelling racial slurs and saying that they 'ran the country now' during the attack. This occupied the news for one night.

The president was stupid, plain and simple. Mr. Gates was stupid, plain and simple. History has proven that whenever we react without knowing the facts it will come back to bite us in the butt. Obama is not on a real estate investing blog giving his opinion, he is the president of the United States. That carries a lot more responsibility than he realizes apparently.

All races, religions, and cultures are faced with bias in many different ways. I can think of no race throughout history that has endured as much as the Jewish people. Even with the constant threat of their neighbors, they continue to succeed.

The beauty of this country and the freedoms we are promised in our constitution is that if you are faced with an ignorant person that will not give you a chance, you have many other options available to you. Personally, I have been told by a black supervisor that he didn't want me there because I was white. Some friends suggest that i sue and all that crap, but if he didn't want me there, then I didn't want to be there. I have heard all the arguments about whites not understanding what it's like to be black. But the same is true in reverse also. Blacks do not know what it is like to be white. Regardless of skin color, religion, nation of origin, etc. life is hard. It can be too much if you allow it to be. And from what I see, there are many self appointed black leaders who are quick to blame a white person and chase down a microphone to accuse him of racism regardless of the facts.

We were all made by the same God, and in this country there are opportunities available to us all. In fact, there are some opportunities available primarily for minorities.

Lets start being honest with each other and call BS for what it is. Slavery was a tragedy, but the blood that was spilled to end it was the blood of white men by a large degree. There are several avenues of recourse available for anyone who has truly been discriminated against. However, there are nor will there ever be laws that will end ignorance.

In this case Obama was the biggest racist. With his position and influence he should have been the last person to cast stones.

All I can tell you is that I wouldn't do it. I'm no angel, but this type of deal would cross the line for me.

- The bank is being blindsided here. There are offers coming in which the agent involved is not presenting. This is to open the pathway for you to make a low-ball offer and get it accepted.

- As Jon mentioned, you will have to state that the seller is not benefitting from this transaction when he is.

- Business wise you are gtting royally screwed. Even HML's get more than 10%. And if the property ends up selling for less than the $350K you say it should sell for the game changes. From what I understand of your posts, your 'mentor' is locked in on his $90K. This will leave you with 100% of the risk and less than 10% of the profits.

- Whenever there is anyone who wants to be on title while not supplying anything I don't even consider it. I believe in your gut you knew that was wrong, and you opposed it. But what it sounds like to me is that your mentor is determined to get his money back by risking everything you have at this point. In business, integrity is huge. Since you have a mentor, I will break the Golden Rule and 'assume' that you are relatively new to this business. In this one deal, someone else is risking your credit and integrity. Without one of those you can make it a ways in life. Without both you will make it nowhere fast.

- As far as the banks mentallity of " I will take a loss as long as they don't make a profit". Put yourself in the bank's shoes. By lending money to someone you didn't know, they were able to gain something, the house. If they cannot pay or otherwise ask you to accept a loss on your loan, can you honestly say it wouldn't matter to you if they profitted? On the front side they gained a home. On the back side they gained cash. You walk away at a loss. I know I couldn't do it.

There are many on this forum that have a wealth of experience. They have given you some great advice. A lot better than what you are getting from your mentor.

As I mentioned, I could not do this deal. I hope you don't either.

Have you made any efforts to contact the neice and nephews that are on the land trust to find out if they want to sell?

Contact the next of kin. Unless the bank has already FC'ed or if you have an Authorization to Release on file with them, they will not talk to you about it. Besides, the property may be in probate and have someone other than the son acting as executor. He will be able to tell you who to contact.
Whether I am dealing with a property in probate, pre foreclosure, or an expired listing I present myself the same way to the seller, that is- I can offer a solution regarding the property. Their situation is relevant in knowing what kind of scenario would fit their needs, but in most cases it doesn't change how you approach the seller. For me anyway.
If you see contacting him as "heartless", I'm sure he will too. I'm not a true believer in mind readers and all that stuff, but I do know that if someone is nervous or uneasy about something, they give off non-verbal clues. How would helping him solve a problem with his father's property be "heartless" though?
