Hi All- just getting back to this discussion. To answer some of the questions- We absolutely keep good records. Thankfully we haven't had to rely on them yet! They've been late every month, but when they pay they have been good about paying the late fees. We were definitely not going to try to do this without a lawyer! Luckily it didn't get that far... Update on the situation is that their complaint to Fair Housing was basically that we weren't taking responsibility for their lost check. Fair Housing connected with us, but since we didn't violate anything they dropped it. Thankfully!!! Thanks for chiming in all! Reading the responses definitely calmed my concerns and relieved the stress of it.

To add further context- they've been late on rent every month for 6 months (usually WEEKS late). We were gearing up to not renew the lease (month to month). Now I fear that they'll use this to claim that our choice not to renew is retaliatory.

Thank you Thomas S. . This is our first property and first experience with this. I know we haven't discriminated, my only fear is them putting their "spin" on something to make it appear discriminatory. Hoping we can resolve this quickly rather than slowly, but guess we'll see.

I'm in CA, and a tenant has filed a Fair Housing complaint against me. I have no idea what for (Fair Housing has not called us back), and I treat all my tenants the same- same rules for all. Has anyone here been through this? How did the process go down? Is the burden on me to prove that I did NOT discriminate? Or on them to prove that I did? To add some context, his June rent was lost or stolen out of the mail, and he's angry at us for still requiring him to pay June rent. We told him we sympathize with his situation, but unfortunately the theft is not our responsibility.

Jeff B. Thanks, Jeff! I think I was using the wrong terminology. I meant looking for value add opportunity. Hopefully consulting an appraiser can help me find value adds where the capex is exceeded by the value add. Ever heard of anyone using an appraiser in this capacity? I guess that's ultimately my question... if it is common or even makes sense to do so

Jeff Sheraton Thanks, Jeff... I may just do that. Unfortunately, they'll pay the desktop appraisal (which came in low) and I'm on the hook for the full appraisal if i decide to go forward... about $750 for a multi in that area. Just need to decide how confident I am that the valuation will come through!

Has anyone here ever hired an appraiser JUST to get their input on what they can do to force appreciation? Im trying to get a HELOC on a rental property, but the desktop appraisal came in too low. I'm thinking of consulting with an appraiser just to find out what I can do to the property to force some appreciation. Has anyone else done this?

Elizabeth Wilson thanks for the nudge. I suppose with a list that small, the worst case scenario is that I waste a few hundred bucks going after it.
