Post: Suiing the seller

Folks

My seller isn't acting in good faith on this SFM property in a NYC borough I'm trying to buy. There is a provision in the title where she can cancel contract if it's over $500 and it's about $5000 but I've agreed to pay for all these costs. Also, the seller or his attorney has not called out on this provision to cancel (they are incompetent enough to not know off it is my guess) but have simply stopped responding to us and keep saying 'not acceptable' in their emails

My attorney thinks I can sue for them not acting in good faith but isn't sure about the length or the cost of such a lawsuit. Is there a basic lawsuit I can file to establish a lien on her house or should I sue her to bring her to court and force her to sell the house? What are the approximate costs to start the process and what sort of total costs would I be looking at? If it's too large, I may not go ahead with this as I deem my chances to be 50/50

guys

i'm sorry for posting here but this forum is all I have access to. I am a 1st time homeowner and am looking to understand the diff between HO2 and HO3. I'm in NYC and not in a flood zone at all. The difference between these quotes is quite large (1200 vs 3000). Are there any 2-3 important items including in HO3 that aren't in HO2? From what I hear, many homeowners simply avoid putting in claims as it results in a big increase in their premium and unless there is a loss of a sizable nature, they just eat the costs

Folks

I only have access to this forum so apologize for that. My wife owns a condo that was purchased before marriage. Since her last name changed, I want to know if it's required to change the name on the title & deed records. Or can we simply provide the marriage certificate in a future transaction like sale and that should suffice? Please note that the property is strictly in her name (nothing concerns me getting onto the title, etc)

Guys

I know some landlords won't like this but my landlord has used quite a few unethical negotiation techniques that don't make me feel too bad about trying this

I'm currently the highest paying tenant in a 20 apt bldg - I've been here the longest and have his Craigslist ads renting apts for 10% lower from only 2 months ago and he rejects them as being for another bldg when I know it's for my bldg because the description fully matches. The landlord is again demanding an inconsiderate increase.

I plan to send him a fax telling him I cannot afford an increase and will leave in 30 days and see what he responds with. I'm hoping he agrees to that but if not, can I call him back in 3-4 days stating I agree to his increase and will stay on. I can't really move because I'm also in the market to buy something and this landlord allows me to leave anytime during the agreement with 30 days notice. What do you guys think about this strategy, could it backfire?

Well I saw an attorney already and he wasn't too clear - he just kept saying I should not have her on the title. I only plan on having her on the title after the wedding and then, she'll start contributing to the mortgage too. I don't mind if the property is split up but just want the down payment to come back fully to me since I paid for all of it

Folks - if I buy a property today (pre-marriage) with a large 30% down-payment, will this down-payment be protected in a divorce settlement 5 years down the line? After getting married in 6 months, I'll be adding my wife to the title

Or will a judge see two people on the title and simply say property belongs to both equally in spite of me being the sole contributor to the down-payment

Guys - this may not be a typical question found here. I'm about to buy my first single family house (just to live, no investing or renting out). One of the reasons is to avail of the mortgage interest deduction
However, me and my partner are also close to hitting the 328,000 joint filer phase-out exemption limit. I'm guessing you cannot take any exemptions if you cross that amount. Can anybody validate this? I don't see any benefit of the mortg interest deduction because AMT will account it as income when calculating the taxes anyways
