All, hoping to get some feedback from the forum.
I purchased a duplex last summer and inherited tenants in both units. The tenant in one unit is on section 8, which covers 75% of the rent payment. The tenant has been late in the past but always caught up, including late fees. The tenant is now 2 months behind.
Normally I would follow my process, of a late notice after 3 days, and then start the eviction process. There are a few reasons I have yet to start the eviction process.
1. The unit will need a few thousand dollars in renovations before it can be rented again.
2. Winter is a very tough time to rent a unit in the area and may sit empty until Sprint
3. The property is very high cash flow, even with the partial rent payment the cash on cash is above 25%
4. The tenant does not make trouble, other than late rent
5. There is a security deposit that is more than the outstanding rent, and would cover another month of partial rent.
I am continuing to reach out and work to set up payment, and I am within the rights of the lease to start the eviction process. The cost of the eviction, renovation, and vacancy while finding another tenant will cost more than the lost rent, even if it continued for the remainder of the lease.
I could start the eviction process immediately, or wait until Spring when finding a new tenant will be easier, or get what I can and let the lease run out until September.
