Honestly, this is not an attractive assignment. Your buy box is huge, brokers will not cross small multi family and industrial across the state.

Purchase price is What $1m or 3m with debt? Small comissions unless you are willing to pay 10% (you should state that)

Yes, its done. I think if you need to show a slightly different use, prove a fit for truck court, etc.

Otherwise, not a lot of benefit to add racking.

There is always a chance the tenant will pay the higher rent if you renege on your verbal agreement, but like all relationships, trust will be broken.  And of course, they may choose to not renew.

Also remember, many listings are priced with the LL assuming at least some improvement costs needed for new tenant, which you don't have.  And if the market rent is only 10% more than current, you have to rent the space pretty quickly to not end up losing money on the turnover.  If the market rent is 20%+ it makes more sense to have some vacancy, but again, you will likely have some buildout for new tenant.


 Thats fair, but we have no idea what his delta is. If he's 50% off market and they have plenty of assets and cashflow to cover a prolonged vacancy, then the smart move is to re-trade. We just don't have enough information, but those are his two options.

 We use a standard engagement letter, we typically do represent one party.

I'm in Texas. I recommend asking the attorneys what their ideal client looks like, what are major issues vs minor issues. How they bill and ultimately find someone you trust.

We do this, hourly rates and pretty common in Texas.
