Because they way Sec8 does it, is that their local Sec8 inspector is suppose to the know the market rate.

So, let me clarify this.  You can list it for what ever you want as the owner.  But they can say what they believe is the on going rate for the unit in that area that sec8 will pay.

i.e you list for 1800, they say 1725.  You can take it or leave it as your 1800 is the list price. 

What you can't do is adjust that amount to different tenants because if you gave it to someone else for 1725 or less even though you said 1800 and them NO to them for 1725....do that enough times and that may cause them to think you are discriminating against sec8 tenants.

those numbers are reasonable.  the constable I had used, server the Execution letter and told them to leave. He did not hire the moving company hoping that in the few days that the tenant left on their own.  This way the moving company takes alot less and charges accordingly... no set $$ value unfortunately.

Yes, as others have stated. TAW is a lease and it is carried over.  But you really should have a copy of the original lease to protect yourself.  As for the comment, it actually is sort of true, absence of an agreement, the landlord is required to pay for the heat.  That is why if you read any "standard" MA lease is will state that it is the Tenants responsibility to pay for it.  Without that, you do have to pay it.

So, look for the lease!

Of course, this will ne all moot once you have them sign your lease.

I understand trained service animals, but emotional pets is getting way out of hand. but they are almost treated the same.

Also, it would help if you could possibly tell us which state the property is in.  This will allow folks in that area to possibly provide links to the court evictions (if they are online).

It has only been 3 years since he was evicted.  Now he is looking again with 1 month on his current lease to go... WHOA!  This might be an indication that the current landlord has already told him that they are not renewing them. i.e late payments ?

That should be enough to tell any of us NO !

Are you really on the same page as the rest of us?  You replied above that "most of us said to move forward"... I read most of the posts and they were mostly saying NOPE!

You do know they will not give you November's rent (if they were ever going to do it ).

Be prepare for them to call you asking why and can they change your mind.  Have your answer ready. i.e.  Unfortunately, I need the place for family. Do not elaborate anymore than that.

If they ask to stay a little longer....Unfortunately that won't be possible.  Note: if you did, then you would have to hire the constable again AND they will know your a pushover!

Did you get any security deposit funds ?

so, with October's rent, you can not move forward for eviction for non-payment. 

So, I asked earlier, do they have a lease? 

If they have a lease then you can try to evict base on a violation of the lease. Of course this has to be serious and with solid proof and a judge probably still won't allow unless its more life threatening, 

If they do not have a lease, then move forward by giving them a 30 days notice to quit ( a full month term) as you are not renewing because you have that relative that is going to move in.  This ha to be done before the 1st of the month.

If you want to wait for November to see if they pay the rent, then once they do not, on the 2nd, serve them a 14 day notice to quit for non-payment of rent.

Stephen,

Congrats on the purchase.  Time to get to work!

1. Do they have a lease?
2. I understand the last month's rent was used  by the seller, but did they pay the rent for October? It does not matter if you received the rent or the seller (if seller, then you should of gotten a portion of the rent at closing).  Either way did they pay for October?

Hi, I know this thread is 4 years old, so I was wondering if there is any thought or change to the idea that the tenants should make the rent check out to the property management company or owner ?
