Subject to can be tricky. Have you asked the person who trained you for direction?

I would have a local attorney put it together for you. You are dealing with a divorce case and you have no way of knowing how the divorce decree split the property. You are dealing with two people who are no longer agreeing with one another. The person you sell to needs protection.

not a lawyer but I was under the impression that Texas does not recognize quick claim deeds, only warranty deeds, I'd look more into that. as far as the due on sale clause, everyone i've spoken and have done AMPS, sub-to, or title transfers, only one person has ever have a due on sale clause initiated cause in retrospect banks don't care how they get their money as long as they do.

not necessarily a new member but Ive been lurking in the background on and off, finally decided to introduce myself. I am Richard, physical therapist by trade and in the beginning stages of real estate. Currently operating 1 long term rental in the NW Houston area.
