this thread is very enlightening and telling of how many people view certain people when it comes to real estate investing. 

@Dominique Pradel-Lewis yes this thread was very interesting but through it all we did get some good answers. The seller was in fact trying to ‘research’ how to keep our earnest money, but after contacting his lawyer he realized he could not and signed to release our earnest money. I’m still shocked he walked away and didn’t make an attempt close the deal. I was told by his listing agent he did not want to drop the price and was upset the contract didn’t allow him to keep our earnest money. I think he made an emotional decision that may come back to bite him in my opinion. Hopefully through this very long thread there good info to help someone.

@Cody L. You see you don’t read but I guess buying 3mm properties cash means you don’t need to right? If you read previous posts our financing wasn’t the issue and wasn’t being used as our out. Our OUT was the appraisal and if you took time to actually read and understand it then you wouldn’t give out misinformation. No need to waste anymore of your time I’m sure someone out there needs you to swindle them out of their earnest money since you very much seem the type. And to hope we lose our earnest money because your comprehension skills are shorter than your posts is hilarious but not surprising. Thanks for taking out your hard earned time to respond as I won’t anymore.

@Greg H. To answer your question financing was no issue we were all set to close, as lender was only waiting for appraisal had seller dropped the price to make necessary adjustments. In that TREC under third party financing part D it’s a FHA/VA provision not boxes to be checked, that states the need for appraisal to come back at agreed price. Solely because it was fha that appraisal trumped any other agreements. We met all of the scheduled deadlines per the contract.
@Randy E. The appraisal came in the 24th we signed the term of contract on the 26th the day before closing as the seller stated he did not want to drop the price to 260k even though it appraised at that. And we weren’t going to pay the difference which left us no choice but to terminate.
@Greg H. Fha is owner occupant only you cannot buy as investment. That’s where I’m seeing some make comments on fha and don’t know how it works. I do know you can use fha for 5+ units but the terms are crazy. I’ll take the help I’m not opposed to it but giving out misinformation then calling me misguided for not accepting it is crazy. It was definitely a insightful
@Bill F. Our realtor and listing agent are getting 3% so how is that cheap? And this whole presumption with liberals and cheap agents i keep hearing is there something being insinuated here? I use biggerpockets to get advice,comments, facts, opinions etc as what this forum is suppose to be used for or so I thought.
@William C. Yea I’ve talked to her constantly to the point that I mainly only text or email her as she hasn’t been to understnmanding of what we’ve wanted in this whole process. I feel I should just call the listing agent myself and our realtors broker as you suggested. This property is good but not the best but this has been over 30 days and we’re ready to close the deal and not just take the emd and run. The seller hasn’t been easy to deal with as we have him everything he asked for and now at the end he is holding up closing. I honestly don’t know if he is after our emd but maybe trying to get his agent to take a pay cut to cover some of the 8k difference. I think I unintentionally gave folks the idea it was solely about us getting back our earnest money just because when we really just want to close. And yes I may be wIllIng to throw In a extra 1k to help but I underdtand my agent should be workIng thIs out but I can tell shes gIven up.
