@Bjorn Ahlblad that’s what I’m thinking. Our realtor and the listing agent wants to make sure these tenants will leave but will also get their full deposit back as well. I know I’m most cases since they’re legally on lease until August I as the new owner would have to abide by that.

Does anyone know in Texas if this is legally binding. So we’re looking to purchase a duplex owner occupied with 2 tenants in place at the moment, Unit 1 until August 31 and Unit 2 until April 30th. Now the most logical decision would be to move into Unit 2 once her lease is up in April, but she has been there for 9 years and doesnt want to leave and Unit 2 has stated they would move out sooner if possible to get a bigger apartment. Now my realtor wants the seller, tenants and us to sign termination of contract stating the tenant will move out within 30 days after closing and will receive their whole deposit back in return minus damages. Now my question is will this hold up in court if after closing the tenants change their mind and doesn’t want to move out?

@Danny Webber yea I hope so. I’ve never encountered that issue but see I will have to get used to it in this area.

So may be looking to sell our property in a few months doing a 1031. Any realtors knowledgeable about selling four unit properties in the king county area?

@Josue Vargas yes and I’m not real familiar with the areas here as of yet. I was told the Pflugerville, round rock areas have a lot of those issues. Are you aware of more precise areas? And also would you know a good structural engineer?

@Jeremy VanDelinder ok that’s what I’m kind of hearing but I’m seeing some sellers have had foundation repair with a warranty prior to putting on market and some didn’t.
