I'm not certain, here, but I think that Medicaid is entitled to the proceeds of the sale of the house, up to the entire amount paid for nursing care for his parents. So, it may not be possible for him to pay the lawyer from the sale funds.

Matthew, it is up to you, but outside of the ethical element of being an aboveboard landlord, Fairfax County refers to their zoning enforcement officials as the "Strike Team". That county does not play. Can you update, please? Hoping all is going well for you!
