Post: Real Estate Wholesaling and Assignment of Contract in California

I have a question:

I just got off the phone with a Real Estate Attorney (from Legalshield) because I wanted them to review some contracts for me to do some Wholesaling and Assignment of Contracts here in California.

The individual tells me that I will need Real Estate License to do this.

He says that I would be engaged in Real Estate Sales and considered a Broker.

Now I have done a bit of research, but by all means, I am not savvy enough to contest his claims.

So I come to Biggerpockets with this question and ask for any feedback or information that may help me discern the truth and get on the good road.

Can anyone help shed light on this for me?

  • Do I need a Real Estate License for wholesaling property and using an Assignment of Contract to gain equitable interest in property?
  • Does marketing to the public increase the chances of running into problems with Real Estate agents who try to foil up my deals?
  • Is this why it's better to build a list of Cash Buyers instead of marketing to the public?
  • And if I do decide to market to the public, do I advertise, not the property, buy the Assignment of the Contract to potential RE Investors?

You will definitely need a real estate agent, but I would not depend on them finding you deals or determining what a good deal is. It takes time, looking at many houses and lots of cacluating to decide what is and what is not a good deal.

I've heard you need a Real Estate agent for running comps (among other things). What sites or tools do you use to run good, up to date, comps?

Thanks for the input. I've read, and been told, that I will need a Real Estate agent for certain tasks such as, accessing the MLS, running comps, etc.

I have been checking out the local Real Estate sites here in town and one of them actually list properties with real estate investor friendly keywords.

Comps on the other hand I think I understand but since I am just starting out, I am not too confident of my understanding or assessment.

Mark, how would you recommend I tackle these tasks and gaining more understanding and confidence in these areas?

Thanks for the response. I know you are right, but it did make me take a backwards step and try to ascertain which message I am wanting to relay.

I have an REI meet up this Tuesday so I am looking forward to learning and meeting some new people.

I will definitely check out the BP Beginners Guide. Is that the Free Real Estate Ebook?
