Please seek the advice and counsel of a local RE Attorney to help you do this right.  Terms are all negotiable between the parties.  Paperwork and structure of the terms needs to comply with State laws..even for private money from friends and family.  It's better to be safe than sorry.  Its always wise to have an Attorney to guide you in the beginning...just my $0.02 worth.

If the ex-husband has violated the order of the court, by not keeping current with his court ordered payments on the mortgage, the judge can order the lender to do a "name only" refinance.  Ask your Attorney about it.

The best source for a definitive answer on this is a RE Attorney.  Mine is Patrick McKnight, Esq.  He's in Las Vegas, and his number is 702.521.6800.  Tell him I referred you.

Beyond the legality issue I will say that most private money lenders are not likely to be excited about your structure of the deal.  The reason is because we make our money with money.  And the faster we turn our funds and the more often, the more we make.  So we structure our lending terms accordingly.
