Wanted to see if there are any further advice or recommendations from this team to help me to resolve this issue. Any lead on the real estate attorney would help as well as I really need to take action to resolve this issue. Thanks again for your support.

Upon further investigation … I only see his wife with the expired TREC registration and I will file complaint with office of Attorney General as suggested here. However, since I cannot forgo the unpaid rents in good conscience … it will be helpful to have your prospective or experiences with collecting debt in such circumstances. Thank you!

Thank you Tim and Nathan for your quick response and expert guidance and I have begun the property manager transfer as suggested. 

How about my options on collecting the delinquent rents that they had been collecting but not depositing to my account. Any suggestions around taking legal action against the company owners, lodging complaints to BBB and other media outlets to publicize their unfairly actions … especially as their intentions looked fraudulent to start with (person that I had approved and thought was my tenant had never applied and turns out to be someone else. Sorry, I never had to deal with tenants directly before but when I called the number I had on the contract they were equally surprised that someone had used their home loan application info and they had never applied to rent). Please suggest as I want to resolve this a right way. Thank you!!

We have a rental home managed by a local management company in Houston. We just found out that current tenant is not someone that they had sent me for approval and they have not deposited rents that they are collecting. 

Currently, we are in the process of changing to new management company but need some advice.

1. What to do if they don’t cooperate to transfer and provide tenant info, contact, deposit to new management company?

2. What are my options to collect rents that they have collected but failed to deposit to my account.
