I agree with @Salvatore Lentini  If it's in good shape, and especially given that it's already covered up, it wouldn't bother me - especially for a buy and hold. If you're flipping, some buyers might freak at the term without knowing the actual risks.

I understand, as it's tough dealing with damp basements. It's always easiest to keep the water out than deal with it once it's in. If you've already tried the first step by observing what happens outside and in during a heavy rain - making sure that water is redirected away from the foundation by making sure that the gutters are working correctly, the downspouts are emptying at least 6' from the foundation, and that the soil is graded away from the foundation - and you're just looking for a quick fix, you might try plastic or fiberglass wall panels. I can't speak for them personally, but Lowe's and HD appear to stock them...a quick google search will turn up a number of companies which make them.

Unless the DWV system is scoped, the possibility of having a main soil line in the process of collapsing.

I agree with @Bill S. Better to attempt to collect later than to throw a monkey wrench into their plans for leaving.

It's much easier to be patient when you see what the fruits of that patience bring you. As tempting as it may be, if it's not broke....


We really need a case that shows someone who was fined for selling/assigning an option contract or marketing a property that they only had under contract.

This is true. However, there is a separate issue that's also raised by the newsletter: is there going to be a change in focus going forward? In particular, it appears to be a warning for agents working with wholesalers. I'd like to get a clear statement from the Division about their current interpretation of code, as well as if there's a change in emphasis.

(Chalk it up to personal education...I'm not even a wholesaler.)


I'm not attached to the issue. I'm not in OH. I close on almost everything before marketing and reselling, and always act as a principal. I wouldn't advertise a property I didn't own for sale. I stay pretty far away from anything that could be perceived as licensed activity.

But if OH is fining people for wholesaling activities, let's find out the specific details.

Agreed. I've actually contacted the Board to see if they will provide additional details about these cases. (Yes, there's a torrential downpour going on right now, and evidently I need to refocus on actually getting some work done.... :) )

It's a disciplinary action by the Division of Real Estate & Professional Licensing. As mentioned in the article:

The relevant Ohio code: [...] The commission shall decide whether to impose disciplinary sanctions upon a party for a violation of section 4735.02 of the Revised Code. If the commission finds that a violation has occurred, the commission may assess a civil penalty, in an amount it determines, not to exceed one thousand dollars per violation. Each day a violation occurs or continues is a separate violation. [...]

Same thing that would happen if you practiced law without a license, cut hair without a license, etc. @James Wise isn't making the rules, he's just telling what the rules are and what may happen if you violate them. Obviously, there's lots of wholesaling that goes on in Ohio. However, if you get on the wrong side of someone who knows how to report it....
