That's a great idea! I'll get my GC in there to give me a quote so they know I'm still serious & just keep in constant communication with them.  Like you said I'll just let it go but keep hunting it down like I would any other deal.

What would I make the 45 day extension on; the possession day??

Back Story:

I had a seller call me from one of my marketing campaigns, I checked out the property & long story short I was able to get it for the price I wanted.  I wrote up the offer to the seller & she signed/accepted.  The story with the house is the sellers parents both passed away and had assigned her to be the executor of their estate.  A few days after getting the offer signed the seller contacted me & informed me that she just found out the courts don't recognize her as the executor because there wasn't anything in writing from her parents like a will stating her as the executor.  The house is now going through the probate process which can take months for her to get the rights to the house again.  

My question:  Is there any way to ensure I still get this deal once the "seller" gets full rights to the house again?  Like promissory note or something?  Or do I just have to trust I built enough report with the seller & keep following up with her?  Any suggestions would be appreciated. Thanks. 

That helps @Penny Clark, thank you! That's one thing I didn't do is ask those specific questions to there previous landlords. Definetly will do that next time!

Thank you for the advice, cash for keys sounds like the best way to go!  When I took their application they where model tenants on paper. Both are university students, have part time jobs, Mom co-signed, got references with glowing reviews.  The guy has a bad habit of screaming at his fiancé... Unfortunately no way I can think of to really predict it... Just a situation where I can just deal with head on now that it's happening.  Thank you again for your helpful post!

Hi Tyler, great job getting your 1st duplex! My thought on the second tenant situation is if he is a great tenant & you are wanting to only raise the rent by $100 per month it may not be worth it. You'd be better off just increasing it a little every year until it's caught up. If miss out on 2 rental payments and you find a renter @ $800/ month for only 10 months you 1st yr that's 8k/yr. Where if you leave it at the $700/ month with a stable great tenant that's $8,400 for your 1st year. $700 x 12.
I bought a duplex & moved into the bottom unit May 1st. I have had tenants living there since April 1st & I've had 3 major noise incidents happen in the last 30 days. All 3 incidents the tenants where yelling at each other & fighting (sounds like it might of got physical with the loud bangs I heard) for 10-15 each time. It was not a normal couple argument, it was the kind where you feel scared & unsafe. I live her with my wife & 2 daughters 3 & 7 months. Nobody needs to hear this especially the kids. My wife was in tears because it was so disturbing to listen to. After the second incident I gave them a warning letter stating that if they don't stop the excessive noise, swearing & yelling I will be calling the police & evicting them. They said it will never happen again & they where super quite for only 1 week. Today I came home & they where at it again yelling at each other & their window was open and all the neighbours where outside listening & asking each other if they should call the police. I called the police & they dealt with the situation. Now I have to follow through with the eviction & I'm very nervous because it's only my 2nd rental & 1st eviction. Just wondering if anyone has any suggestions or words of encouragement? Thanks!
