I emailed my realtor 3 days ago saying I wanted to put an offer on a property. He said he could talk tomorrow AND he's looking into the property for another client as well. Can he represent both of us fairly?

I'm learning about HELOCs and also have a home-with 2 separate lots. I was told the land/lots weren't eligible for a HELOC. Maybe it's different state by state? I'm in Oregon.
