Hello BiggerPockets community. I need some legal advice on how to property evict my Tenent and if I even have the right to do it . I am located in Elizabeth NJ I recently purchased a multi family with a section 8 Tenent in the second floor. As I do with all my properties i renovate the unit and rent out for what the market is renting at . Tenent is currently on a 6 month renewal that ends June 30th . Tenent has been paying $1000 for about 10 years . Current market is renting at $1500. It’s a big difference. If it wasn’t I would not even bother and keep them . Can anyone advise of what I should legally? Thanks in advance.

@Alexander Mair not in Detroit but with a similar area in NJ(Newark). Section 8 is usually the option in tuff areas.

no way. With 12k that’s a down payment with a fha loan at 3.5% down. After that just brrrr the property. And fund your second deal. So much free info out there. Good luck!

Every state has an area that isn’t the best. It all comes down to screening and putting the right Tenent in place. Maybe look into putting section 8 Tenents in the units. That at least guarantees most of the income. Good luck!

Look into fha lending for 3.5% cash down on a multi family home. Buy under market value and renovate kitchen and bathrooms. Do a cash out refinance on the property to fund your next deal. I am closing on my second home using the brrrr method. Good luck!

Thank you everyone for the replies. My reason for removal of the section 8 Tenent is that I plan on renovating the unit and I like to just screen my own Tenents.

Hello BiggerPockets community, I’m currently in attorney review with my second multi family home. I do have one concern and I’m hoping you guys can help me out. The property comes with a section 8 Tenent they just renewed there contract January 1st and it will be up July 1st. Will I have a problem getting them out once there contracts is up? What steps should I take before closing on this house to protect myself ... thank in advance.
