My tenant is telling me that in NYS, the law says they have up until the 5th to pay rent, if rent is due on the first! Is this actually true because I can’t find a law that says it is?

I was trying to help my niece out by allowing her to rent my rental home. Things were good between us. She moved in a week ago and still has things at her old apartment. I didn’t have a lease signed because I’m new to this and I am still looking for a lease agreement that makes sense for us. We just closed on the house a week ago. Today when I went over to say happy Mother’s Day, I caught her in a lie... again. I told her she had to get out. She had people there doing drugs and all these kids running and out of control . I called the police because my niece is saying I can’t convict her. We don’t have a lease or any document signed. She hasn’t even paid full rent yet. The police told me I had to take her to civil court and evict her that way. How in the world does it make sense that my niece has more rights to my home than I do?

@Hadar Orkibi

Thank you for your info. You obviously recognize that I have no idea what I am doing. You certainly gave me a lot to think about and I have quickly got your point. I appreciate you for that. My husband and I have a lot of money invested in the stocks, mutual funds.. etc. With the stock market so unpredictable and watching people lose their retirement, I am looking for other ways to invest. People were suggesting duplex’s, so that’s why I was throwing that idea out to the community. You guys are much more sophisticated and educated on these topics and ideas. This is certainly not my wheel house!

@Hadar Orkibi

No, I’m not a builder. I’m just looking for ways to invest in rental property. I am not interested in buying apartments or houses that need to be repaired or flipped. Trying to decide if rentals are a good alternative to investing in the stock market. Looking to diversify.

What are your thoughts about buying land and building duplexes to rent.

@Matt Leber

Thank you so much for taking the time to respond. I am thinking your right. To just wait! It seems like it’s the easiest.

I’ve been reading that when section 8 does their inspection that the house needs to be vacant. Does that mean everyone needs to be out of the house while they are doing the inspection or that people and property have to be out of the house? Thanks again.

(Located in New York) I am about to close on a house that I purchased to rent to a family member. Her application for section 8 has not been approved yet. While she is waiting for hers to come through, which would be much higher ($1,400), she wants to use her boyfriends. His is much lower ($750) Can I rent to one section 8 tenant for one price ($750) and then raise the rent for my niece ($1,400), with a new contract, at a higher rate? In other words, is the house approved for section 8 based on the house itself, or can I rent to new renters with a higher voucher? I want to make sure I don’t low ball myself by taking someone only approved for a $750 voucher. It’s a 3 bedroom house and the boyfriend is approved for 1 person. The niece will be approved for 2 plus a baby on the way. The market rental price is between $900-1,700. So for his rate alone, it will be lower. Will he not be approved because the house is deemed too big for one person, even through I will accept his rental voucher? I hope this makes sense. Right now with the corona virus, I can’t get a human on the line to answer my questions.
