Ayman Elmasik - as a licensed agent, I advise all of my sellers that they should disclose all material defects with a property in the listing. The Texas Real Estate laws requires sellers disclosures on property conditions to be provided to potential buyers. I would be happy to answer any specific questions you might have but in short... Yes you need to disclose that there was evidence of prior pest treatment and mold remediation. Feel free to message me if you would like to chat in more detail.

I'm not an attorney, nor am I giving legal advice.  BUT, as a licensed agent in Texas, the language in the promulgated forms issued by TREC are not supposed to be amended.  While you can write in special terms in certain areas, I would strongly encourage you to get the assistance of a real estate professional or attorney to make sure that you're protected.  

The only impact that the exclusivity agreement has on the arrangement is that the property owners will still owe the listing broker commission, regardless of if the transaction is initiated by the broker or seller.  

Best advice... get the assistance from a professional that is experienced.  You don't want to leave yourself unprotected.
