I have a question....Maybe somebody can answer that for me. The Tenant is a Real Estate Agent for a big Realtor in NJ. Do I have the right to contact them, being that I always thought the especially Real Estate Agents should be a prime example on being a Tenant....I am curious on whats the answer to this.

  1. Thank you to everybody....I really appreciate all the good advise. @ Joel, you are absolutely right we are accidental landlords. As of now I do not have a response from her from the letter we send but I promise you this I am moving forward on this. I will not show anymore tolerance when it comes to her rent payments or any other excuses. She either pays up her rent or gets the heck out of OUR house. @Matt, thank you for serving. I will definitely look into what you said. Its worth a try. Can you believe that up until today I haven't even received a receipts for the deductions she did for a kitchen faucet that she supposedly replaced with no permission. To explain a little further, I had hired a contractor to get some fixing done around the house. He presented a estimate through my Property Manager which I accepted. Two weeks later as he was starting to do his jobs at the house the tenant informed him that she had already switched out the kitchen faucet. The contractor called the Property Manager and informed her of the changes. The Property Manager called the Tenant and told her if you changed out that Faucet these costs are on you being that she had no permission from the Property manager nor the Landlord. She said ok. 3 Days after the Work was completed by the contractor my Property Manager followed up with the Tenant to make sure all the work that was discussed was done. She replied yes, no issues. The contractor deducted the Kitchen faucet work from my bill. It was not until a week later when rent was due that she decided to deduct the money for Kitchen Faucet and got really smart with my Property manager and I mean really nasty smart. That's how this drama all started. I am not a Lawyer but I know for a fact that this is not allowed. And who does she think that not only did she not have permission, she didn't even send a receipt.

Thank you for the warm welcome....

First of all let me say that I am not disagreeing with some of the things said. We are Military and was forced to make the move we made to relocate. Short sale.....yes we considered but it would help our situation here. My husband has a security clearance and that would affect the renewal being that the short sale would hit his credit report. Well, I did inform her yesterday via registered mail that she is being charged with a late fee for not fulfilling her rent payment as stated in her lease and she was also informed that she had no authority to make any deductions from her rent without prior approval from the property manager or us. If she does not deposit her missing portion we will keep our self the right to deduct from her deposit. Being that it is stated in her lease I think I should just use a Lawyer and charge her. The only plus I have with her is really the fact that she is OCD. I hope the letter scare's her a little for now. I am just so tired of it. I read up on some of the law and basically they are saying as long as she pays her rent I have no leg to stand on...I really appreciate everybody's reply. Keep it coming...

I need some help before I go crazy. We have a property in NJ with a Tenant that is just completely out of control. This is her third year with us. It has been hell...When the third year started we decided to hire a Property Manager which is also a friend of ours. Well today is the 2nd Day of her new lease and the same crap is starting all over again. She makes decision on her own. Deducts money from the rent which she has no authorization at all and basically blew off my Property Manager via email telling her to get a hobby instead of having a discussion with her. Of course we could have sold the property but we were not prepared to come to the Table with coming with 30000 to the table being that the market in NJ still hasn't picked up. Now my Property Manager wants to quit on me because she is also at a point that she cannot take her abusive and down talking way anymore....there has to be something we can do.

I read something earlier that really sounds good

Given the belligerent nature of our emails, phone calls and texts, my lawyer legally requests that we confine all correspondence to written letter unless it is an emergency. By law, I must forward any violations to the proper authorities. Please be guided accordingly."

This sounds great but all that would probably only piss her off some more...I am not ready to lose my Property Manager...

What can I do?

I live to far from NJ to constantly be there and when we didn't have a property Manager....OMG I just wanted to take a ride, she can really get to you

Please help, I can not afford for that Place to be vacant not even for one month.
