I am a property manager and would be happy to help!. We cover the entire DFW Metro but in the interest of what Bigger Pockets is all about here are a few tidbits & recommendations about some other DFW Companies:

Real Property Management Dallas - they are now the largest PM company in DFW (# of doors managed) after acquiring one of the largest PM companies in Fort Worth - Specialized PM and some other smaller ones.  The owner of this franchise did so well he was asked to be the President of the entire RPM company - all 150+ offices!  He is no longer in that role and is focusing on growing his business in DFW.  These guys have a strong reputation and are led by a solid team.

One Prop - I believe these guys are the second largest PM company in the Metroplex.  I have a close friend that works there in Houston (and Dallas before).  These guys are pretty investor friendly and are growing like crazy - they have been expanding all over the U.S.

From my experience people have found one of these two companies to work well for them. 

Lastly, NARPM is a great reference and the chapters for Fort Worth and Dallas are pretty small so the community is pretty tight knit.  You can tell a lot about a company by how many PMs are members of this organization.

Agreed.  I said the same thing to the team working the eviction.  I was told because federal court supersedes county court they were told to stand down until a stay was filed in federal court or the bankruptcy was dismissed despite them having no claim on the property.  They also listed my company as a party he was delinquent to in order to tie everything up.  It is a formality that should be rectified once the documents are reviewed because nothing really reviewed when it is filed.

 I am still stunned.  Boggles the mind!

Hello All!

Here is our situation:

Purchased an occupied foreclosed home in Fort Worth, TX.

Proceeded through proper eviction and won at the Probate level.

Occupants appealed to county level and we won again there. Subsequently, they did not move out so we filed for a Writ of Possession and it was signed by the judge.  The constable served the 24 hour notice to vacate and the occupants immediately went and filed for CH. 13 bankruptcy in order to further tie up the property.  Because this is handled by a federal court the constable/county court is refusing to allow the constable to go to the home for forcible removal.  

The occupants have no ownership interest in the home (so shouldn't be protected by filing bankruptcy especially since we already had a judgment) and we are trying to figure out our options in getting them out.  

Thoughts?  I am doing my best to not go and remove the outside AC unit to make things a little more uncomfortable though that would have worked much better in July when this started :)

In all seriousness I am curious to hear if anyone else has been in a similar situation and the thoughts of the BP community.

Do not let them back in the home.  Evictions in Texas dictate that occupants and belongings will be removed with the writ of possession.  The constable enforces possession and removal of the tenants and the landlord/PM should have a crew to remove belongings at the same time.  

As @Damon Duperre said, all belongings are placed on the curb unless it is raining or snowing.  The former tenants then have 24 hours to collect their possessions from the curb.  In Texas, after 24 hours you have the right to haul off the belongings from the curb to the dump, goodwill etc.

It seems you might have missed the step of moving out their belongings while the constable was there.  I would suggest agreeing on a time to move the belongings to the curb and for them to arrange a way to pick it up or it will be taken to the dump.

Be sure to refer to Arizona eviction law and how it calls out timelines specifically.  I hope this helps! 

We are currently going through eviction proceedings for an occupied foreclosure we purchased and the occupants are fighting it all the way.  They just filed an appeal which I am confident they will lose just as swiftly as the district eviction case they lost. 

My question is this: Do we have the right to enter the property with proper notice to evaluate it?  We still haven't seen inside and would like to document the condition in case of any damage as they vacate the property...eventually.  We have no lease and still haven't been able to talk to them in person despite numerous attempts.

@Ariel Cohen We are scheduled to close Aug. 3...everything has gone pretty smooth.  We were priced above the top of our market and the appraisal still came in at our contract price so we were thrilled by that outcome!

Very excited to finish this one up, currently working 2 more flips and a turnkey rental. I will share more as I get pics.

I concur with @Hattie Dizmond you can sell just about anything in a decent neighborhood in the Metroplex right now.  We are at a 30+ year low for housing inventory.

We just contracted on our flip in 6 days above listing and that was listing it late on Tuesday before the 4th of July weekend. We bought that deal from a wholesaler claiming a 145K ARV and listed it for $174,900 which worked nicely in our favor.
