Post: Located property on my own-realtor wants commission

I have a deal worked out with a seller of a property that I located via my direct mail campaign. Then this realtor calls me claiming the property was listed with him and I have to go though him to purchase it. Now I never met him and he never showed me the property. He says I will have to cover sellers closing costs which include his 2k commission. The seller says that she wants to sell to me as it has been listed with him for over 6 months with no offers. Seller says just go ahead with the sale.

What would you guys do? I will speak to my attorney today as well just looking for some other advice. I am guessing if she does sell to me he will take her to court for the commission. I do not see how I would be liable for the commission when I do not have the contract with him, Thanks

You do not need a ny notary. A notary just is affirming that it is you who is signing your names. Most houses I buy from out of state owners and they have it notarized in their home state.

If it is zoned as a single family why would you think you make it a multi or rooming house without a problem? Im my experience it is not up to anyone to tell you anything- you need to make sure you ask questions about your project and sometimes receive supporting information in writing or print so you can reference it later incase a different inspector has a different view of the law.

Maria,
I am not in Detroit but if faced with a similar situation I would chose to sell especially if I had a buyer. If you are able to get rid of it and it only costs you 5k or whatever now it may be cheaper than the next few bad tenants will cost you. Just my opinion. Good Luck

I agree it was the right decision. They were late anyway with the rent so it would have been my choice as well.

What is the problem? Not saying this is the case with you but I have had tenants who call for every little thing and after a while I disappear and only collect the rent or fix big issues affecting habitability or safety. This might not be your case but just throwing it out there. A leaking toliet-while it is great you notified him if he choses not to fix I wouldn't worry as he gets the water bill.

Big issues (health safety) your in NYC so call the city inspectors NYC is very landlord friendly and it will get his attention.

I will send out another letter to anyone who didn't respond in a 2 months. My best response rate though is from the initial first letter. Almost every property I buy is vacant and needs work.

I use listsource and have good success. (usually 15% response) Sent out 125 letters last month and am closing on 2 properties this month. I think alot depends on what you are looking to achieve with your leads. When I was doing PM services I sent out about 500 letters and received about 8 calls. Only thing is with listsource is I do get alot of returned letter because the address is incorrect or recipient isnt there etc. Guess thats just how it goes with marketing by mail

I use Vumber for my tenants to contact me. When the tenants call my number it goes directly to my cell phone. If I do not answer it will send me an email with the voicemail or I can check my voicemail by calling my number. You can also turn off the number if you want or make the calls be directed to different phone numbers. I like this service because the tenants do not have my cell phone number and adds a level of privacy.

Ok I am not a wholesaler but wouldn't providing a fake pof letter be fraudulent?
