Post: Back in the game, getting ready to inherit tenants

Hey @Soniel Estime,

With respect to inheriting the tenants, I recently came out of a pretty ugly falling out with a tenant that I had inherited. Granted, I made many mistakes on how I managed, and looking back I would have:

1. Immediately served a notice to quit and placed new tenants Ive vetted on my own

2. If 1. is too much work then I would IMMEDIATELY send them your new lease via certified mail setting expectations very clearly, and if they do not agree to the terms, send a notice to quit and go back to 1.

3. Not meet them in person. This was something I thought that I was being friendly and personable as a landlord, but I still ended up getting burned for being nice

Rereading this I feel like I sound a bit jaded, but it’s also better to rip off the band aid early on versus letting the bad stuff build up over time and hear things like “the other landlord was never like this” etc etc

Post: Do I need to follow up with the security deposit?

Hello,

I just mailed out my tenants security deposit (in full w interest blah blah blah) to their specified forwarding address via UPS and see it was delivered per “met customer”. I was wondering if I need to follow up w the ex tenant to confirm they have received the security deposit.

On a side note, Id like to avoid messaging this particular individual due to a pretty hairy falling out that was had…

So lately I've been going through this ugly process of removing a tenant from my property. This is my first property I am house hacking, and I am very new and young to this. This whole process has been emotionally draining, frustrating, and very... educational. Without going into details, I never knew people could be so vindictive and out to get me. Even after I've tried so hard to help them, I am disheartened. The worst part is, I feel like I've managed to mess up everything up until this point. 

To get to the title of this post, I found myself repeating a mantra if you will of "Brandon Turner must've felt this same way at some point, and look at him now". I can now appreciate the suck that a lot of people don't see. All the headaches and mistakes people look passed for the shiny slogan of Real Estate Investor. And right now, I am in the middle of that suck (with only 1 property!). 

I'm not sure why exactly I wanted to make this post. Maybe other people can relate? Maybe I needed to open the pressure valve that binds my frustration in a healthy way? But I can say, that I am thankful to have role models like Brandon and David to look up to, and help me remind myself of my why

Becoming a real estate investor has already taught me ten fold of what I expected to learn, and I am excited to continue learning.

Post: Tenant neighbor smoking (not cigarettes)

Greetings,

I am currently house hacking in CT and I have a question about how to navigate a situation

The situation is: I am in the eviction process (lapse of time) for my tenant neighbor, and there are some serious tension going on. At the moment, it seems that they are smoking weed consistently at night (either that or a very consistent smokey skunk is roaming the premises *insert eye roll)

My question is: can I do anything to stop this obnoxious smell? My roommate and I are getting annoyed with it and the eviction process is very slow. I asked my attorney how to navigate this but have not had a response yet

Any thoughts would be greatly appreciated

Hello,

I served a tenant an NTQ in August on the grounds of lease expiration and personal use (Im in CT)

They were current on their rent all the time, however, they have stopped paying since they received the NTQ (2 months worth of rent) and have gotten very hostile

Should I disable the rent payment system (apartments.com) or leave it open?

My gut says leave it open and not worry about them not paying until I have to go to court and say “hey they became vindictive on me”

Hello all,

I am currently in the notice to quit phase of a month to month eviction. My reason for the notice to quit was due to lapse of time and for my personal use

My question is: the reason for my personal use is I’d like to move in w my girlfriend/fiancé. So, will the girlfriend/fiancé have to be present during the summary process to “back me up” and say yes I want to move into that side with him?

Yes yes I know ask my lawyer but I’d like to avoid half baked answers or pay for 15 minutes of consultation when I can ask members of the BP community who have some insight or experience with this. And yes, I had my attorney draft the NTQ. This is my first eviction/summary process (and i know a NTQ doesn’t mean eviction, but this tenant has made it clear they are going to pick a fight so I assume it will reach the summary process)

Hello, 

I recently gave a tenant a NTQ in August, and is "due" October 1st. My purpose for this post is that the tenant has not for this month. Do I attempt to reach the tenant via certified mail to request they pay me? Or do I just wait until the summary process? Side note, I hope it does not reach the summary process, but this tenant is particularly combative and has also blocked my number...

The verbiage on the NTQ is

ANY SUMS OF MONEY TENDERED TO LANDLORD OR THEIR ATTORNEY AFTER THE DATE OF THIS NOTICE SHALL BE ACCEPTED AS PAYMENT FOR USE AND OCCUPANCY AND COSTS OF EVICTION ONLY, AND SHALL NOT BE CONSIDERED ACCEPTANCE OF RENT, NOR SHALL IT PREJUDICE OR PREVENT THE LANDLORD FROM PURSUING SUCH REMEDIES, INCLUDING EVICTION, TO WHICH IT MAY BE ENTITLED AT LAW OR IN EQUITY.

I do have a month to month (tenant at will) whatever you want to call it lease at the moment. I was thinking about raising the rent but need to make sure that it does not appear retaliatory (I was going to raise the rent anyway, this is all jus poor timing)

I also want to renovate their side so it is as nice as the other side I am almost don’t renovating (sweat equity)

This makes me wonder:

-Can I raise the rent on the tenant side more than the new side as an incentive to move and increase rent?

-Only increase rent?

-Completely notice to quit/evict? (This seems extreme to me but their approach during the whole scenario was “you hurt me so I hurt you” and does not bode well w me even after I attempted to engage in collaboration)
