Thanks for the replys. The law says I can use the security deposit for any rent due If they owe 8 months more on the lease does that justify me keeping the deposit. Or could I only charge them for the time it is vacant until I found a new tenant and deduct that from the deposit? I am new to this and have read the laws. I just want clarification. I am definitely not worried about the legal action they threatened I just want to make sure I am taking the proper steps to "CMA".

I had a tenant contact me and tell me that they need a bigger place to live in and ask if I would write a letter of recommendation for them to move. They signed a 12 month lease and have only been there for 4 months. I told them if they we're breaking the lease they signed I couldn't write them a letter. They then start threatening legal action if I don't give them the security deposit and write them a letter of recommendation to move into another place. My question is do I have to give them the security deposit back? They owe 8 more months on the lease. I'm assuming the deposit is for damages to the property only. But what do I do about the weeks or months of rent I may lose if anything ? I live in WV. This is my first year as a landlord. They have also been late on rent 3 out of 4 months.

She admitted to setting the fire. She had some type of mental episode. I'm not sure if it was due to some type of medication or what caused it. We have fire and police reports. The police recommended we not charge her with arson because she was obviously not with it.

I recently purchased 8 units on the same property in WV. I inherited a tenant. She does not have a lease. She has been paying her rent monthly. Well today my wife happened to be working in the area where the apartments are located. The tenant was walking around trying to open doors on other units , and trying to open vehicle doors to neighboring businesses. She clearly was not in her right mind. Long story short the tenant ends up setting a blanket on fire on a banister inside the apartment. She is at a mental health facility right now. Now my question is what do I do legally to evict her? She didn't have a lease. The fire only did a few hundred dollars damage. Will their be an issue with the eviction in regards to her mental health? Any help for this newbie would be appreciated. My first 6 months in real estate has been a wild ride.

I just bought my first 8 units. I am inheriting tenants. Everyone has paid on time for years except one. It was poorly managed and one tenant has only paid rent 4 times in a year. He has no job. I went to talk to him today. He tells me he plans on moving in with his girlfriend. I wanted this guy out anyway. My question is what do I need to do to start the eviction process. There is no lease, and he isn't going to pay. I'm sure he thinks he will stay there another month.
My wife and I recently made an offer on 8 units and it was accepted. Since then we have ran into some issues. First of all the owner of the apartments had passed away, his family was selling them. It was after we made the offer that the agent said they had to get the sale approved through court before they could sale. She said there shouldn't be any issues. We said that was fine. A few days later she calls and said the lawyer wanted inspection and assessment done before they went to court to find out if they could even sale. It's a few days before the inspection and the agent calls and says that two of the tenants refuse to let the inspector come in. Apparently the person managing them hasn't been too involved. That guy obviously needs to go. This is our first deal. We have 90 days from the bank. Who knows how long an eviction will take. We just wanted to get someone else's opinion. Do we walk from this deal?
