Thanks @Brandon Hall. That's what I also came to the conclusion too after reading through further IRS code. Also shout out to your podcast last year. One of the better technical podcasts that I've heard in a while.

Hello, I currently just bought my first duplex and will be living in the bottom unit with a friend while the top unit is occupied by a tenant. Can I classify my friends rent payments to me as a gift? The total amount given to me will be less than the $14,000 IRS annual gift threshold.

FHA also has the same 60 day move in policy so that will be no help to you either. Let me know what you find out. I was trying to find out the same answers for future purchases, but know one would give me a solid answer.
