Post: Legal Advice for Resolving lease w/ Tenant Death

One of two tenants recently passed. The deceased provided security deposit under original lease, which has been subsequently renewed and in a month to month status. Remaining tenant exploring options to remain at the home. Legally, I believe, the options moving forward would be:

1. the existing lease would have to be terminated due to one tenants death, and the security deposit returned to the legal guardians/ beneficiaries of the deceased.  New lease completed with tenant providing new security deposit.

1a. - if there is a new (additional) tenant they would have to go through new applicant screening

2. provide notice to vacate 

Looking for see if i am missing any component of the next steps in this very delicate situation.

Thanks Rob - i was trying Tellus but found the App only interface challenging, as i prefer to have access to a website as well. I actually went back to cozy when I found that they offer the ability to upload the contract docs, as well as handle payments. At this time I have to say I am pretty pleased, but I really do appreciate the insight. Its always good to have more options than not enough!

Hi,

I am looking for various payment options available to landlords to facilitate faster monthly payments from tenants. Right now I am using Zelle and the issue I’m having is my tenants have to send two payments due to the dollar amount limit. The rent is more than the app allows in one transaction. I am looking to make it easier for them to pay one payment. Does anyone use anything that is fast and easy for both parties? Thanks for the info.

Hi Everyone - I need to reach out for some recommendations and advice from the Pittsburgh BP members. We are working on our third rehab, a SF in Lawrenceville and need to build more connections with local contractors that can help keep our project moving. My husband and I have in the past completed other rentals ourselves, which was fun but with full time jobs we need some help. I want to know if anyone has any recommendations for contractors that are reliable and won't overcharge for their work just because of the area. THANK YOU FOR THE HELP!!

Hi, I’m looking for feedback on what avenues rental property investors are taking to get financing for property purchases. Every bank I’ve talked to requires 20% down which leaves very little for rehab purposes. Are you using the BRRRR strategy or hard money lenders? Any info would be much appreciated. Thanks

Hi Ryan,

I was interested in looking over some city owned properties in Pittsburgh, so your questions about process and pricing are all things I would love to know more about. I know you said you came across the property by chance, and proximity. Have you continued with the process over the last few months? If you have any information (website etc.) that you could share it would be appreciated.
