Thank you for the info. This answered the question I was most concerned about. I didnt want to give all the money back and not be able to find a tenant for a couple months or more and lose a lot of money. It's the worst time to try and move right now with it being so cold, but at the same time I dont want her to feel like I'm ripping her off. I'm going to start making some ads today and sit down with her and explain how this process will work out.

So I just bought my first rental property in St. Paul, MN. One of the tenants I inherited paid for a full year of rent and her lease is up in August. She just called me and said shes breaking her lease in 30 days and wants her deposit back as well as the money for the upcoming months. What are my legal options and what would you guys/gals do if you were in my situation? Any thoughts and ideas would be appreciated.

Hello BP people,

my name in Matthew McKibben, and I just bought my first rental property on January 1st. It's a triplex in St Paul, MN zip 55119. I added that info to hopefully hit some key words so get people thoughts that know more then I about my question/concern. 

  I've been hearing bits of information about Minnesota passing a Bill that will limit my ability to conduct a thorough background check. Does anyone know what Bill it is, or what is consists of? All I've found is that it goes into affect for people with over 15 inits june 1st and under 15 units dec 1st. Tbh I'm not 100% sure if this is even correct. I havent been able to find any detailed information on the bill. 

Thank you for any info that will send me in the right direction.

@David Barnett Yes it's considered East St. Paul. It's close to the line of East St Paul and Maplewood. The Maplewood mall is about 3 miles away.

Thank you for your post @Will Fraser . Right now I am really glad I was born with the ability to just go out and start talking to new people because it really has paid off. For now my goal is to find a bank to get a FHA loan on the property so I can get the seller all of his money. I also have a few projects around my unit that can be undated, but the unit above me was renovated 2 years ago and looks great. From there I am going to start working on the basement to see what it would take to make it a 4th unit. There's a lot of wasted space down there. Our long term/big picture goal is to continue to buy small multifamily properties to buy and hold and work my way up to commercial apartment buildings. We also want to get to the point that we can find a great property manager to run our investments in Minnesota because the wife and I plan on moving out of the state to someplace warmer. Again, thank you for your post. It's much appreciated. I look forward to hearing from you in the future.

Investment Info:

Small multi-family (2-4 units) buy & hold investment.

Purchase price: $245,000
Cash invested: $8,000

This is my first rental property, and it's located in St. Paul, Minnesota. It's a triplex with an over under and a small cottage house on one lot. I was able to get the property with owner financing through my landlord that I met when he bought the apartment building I was living at previously. My wife and I are going to house hack this property and save for our next multifamily.

What made you interested in investing in this type of deal?

I have wanted to get into rentals for the last 5 years, and just got stuck on reading/research. I decided on multifamily buy and hold because of what I've learned over the years. It was BP that pushed me to start looking for deals and telling everyone that would listen about my dreams and goal. So many podcasts talk about how people dont get started because they are nervous or scared of failing so they dont take a risk and buy that good deal that comes along. This fact is why we went for it.

How did you find this deal and how did you negotiate it?

I met the owner when he was looking to buy the 15 unit apartment building I was living at. He's close to my age, and when he came in to look at my unit instead of just sitting there I started shooting questions at him, and told him this is what I want to start doing some time in the near future. This started a relationship, and he became my mentor/friend. So when he was selling his triplex that was further out then he liked I was the first person he came to.

How did you finance this deal?

I had been sitting on the down payment for almost 2 years just not ready to fully commit. I wasn't sure that I could go right out and get a bank mortgage so we wrote up an agreement to do owner financing with the option for a balloon payment once I can get a traditional FHA mortgage.

How did you add value to the deal?

I'm currently living in one of the units and our first project is to repaint the cabinets and struce up the kitchen and then we will be remodeling the bathroom next. It could use knew tile and fixtures. The other units will be worked on as the tenants move out.

What was the outcome?

The outcome has been amazing so far. Like I said earlier this is our first rental, and we just moved in so there will be challenges, but the wife and I are in this together and with hard work and determination I know we will make this work. I forget what podcast it was on BP, but the guest said, "this is going to work because I'm going to make it work" and that has really stuck with me.

Lessons learned? Challenges?

So far the biggest lesson learned was that I waited way to long to start. You really have to make that voice in your saying, "what if you fail" shut up and just believe in yourself and believe in your team (my wife) and trust that you will make this work.

So I just wanted to let you know that I went through with the deal. I am officially a real estate investor vs an aspiring one. So far it seems like my inherited tenants will work out really well also.

    Thank you so much for the information and added confidence. I've heard stories on the podcast, but it's nice to hear from someone on my forum post about their experience. My credit is another reason why I'm excited to have the option to owner finance. I had an accident and broke my back years ago and it really hurt my credit trying to get by. I've gotten it to an ok score, but there's still room for improvement. The seller knows my story and is willing to give me multiple years to get it up to par. Along with my wife's credit. Plus that will give me time to have a couple years of documented income from my real estate career after I get my license. 

   That's an amazing story with great appreciation. You jumped in at a great time. You took the steps to start, and that's what I'm trying to do. You can only do so much research. It's also cool that you buy in the city I was born in. Small world. Thank you again for your response. It really is appreciated.
