Does anyone here have an idea on best approach to deal with renters here in MN that claim to have applied for rent assistance but have not? We are looking to file an eviction but the rules here in MN now state that we cant do so for reasons of unpaid rent if they have applied for assistance through RENTHELPMN. Our thought is that when we take them to court they will just say they applied. If they have then they will have a pending application and we cannot evict until next June. We are quite certain they have not applied but I have been offered the opinion that the judge will simply side with them if they say they have because the judge will be too worried about approving an eviction that could turn out to be illegal and worried about his/her re-election if they are looked at negatively for doing so. 

Are we legally able to start the process by posting the"pay rent or quit"? Has anyone heard if there is going to be some kind of "ramp down" program regarding legalizing evictions in MN?

Is it legal to start the eviction process now in MN?

I have a tenant that has not paid rent in 3 months. She claims they have tried and been turned down for all forms of rental assistance and unemployment. Does anyone know of any new rental assistance programs or one that the Landlord can apply for directly?

Can we evict our tenants if they refuse to sign the hardship affidavit? We have not received rent from them for 4 months. We left them the affidavits to sign but they never sent them back to us or mentioned it when I stopped by. We are looking at ways to evict or possibly just sell-so they other question then becomes how hard is it to sell a rental with non-paying renters? If we do then we would want to 1031 exchange into another property. If we do that does that property need to be picked out in advance of listing? We would rather not sell but the situation is getting out of hand. Thanks!

Wondering if anyone has had success with finding entities in Mn that would provide rental assistance to renter's that are out of work due to Covid?
