I do have a partner, but I thought there could be more than one "members."

I definitely agree talking over the phone may be easier. I am free tonight to chat otherwise during the day tomorrow.

@John Woodrich Okay so just to be clear I don't have to get the new EIN before January 1st in order to claim my income on my 2016 tax return? Just as long as my clients file the 1099 to my new company? 

I see that you are a CPA. I am looking for a CPA to help with my taxes this year. They will be a lot more complicated this year. Can you message me your info?

I have a partner and I can't add him to the business as a sole proprietor. And I have heard from many sources it does help me tax wise.

If I haven't filed taxes yet with my old EIN number can I claim all the income I made last year with the new business? @Richard D.

Also, I tried getting a new EIN number today but the IRS is down for maintenance until January 3rd. Since I won't be getting this application submitted until after the 1st I probably won't be able to do what I mentioned above?

Hello! 

My name is Mariah. I am an independent contractor and was advised to file under an assumed name by the company. After doing some research I have realized I want to file as an LLC. I have called the MN Secretary of State and they said I have to just file a new business as an LLC. But I have an EIN number ... Can I transfer that same EIN number that I was using to the new business?
