thank you @Colleen F. for the advice. I emailed the tenant and tried to be as clear as possible. Awaiting a reply, last we spoke she told me she wanted to wait till Sunday to give me a reply. First i thought why Sunday, now i realize its the end of the month and maybe she will try to withhold last month's rent. I am really disappointed in her already because i have been very fair and nice to her but i think she playing me a bit. Either way, I told her she HAS to move. Will keep everyone posted and thank you for the great advice here.

@Joe Splitrockundefined - Hi Joe, thanks for the advice. Just for clarification. The current tenant told me about buying a house and the issue with her closing AFTER she gave her notice, i found a tenant and signed a lease. I DID tell her to honor her notice and leave but she is not being cooperative at the moment. 

@Daniel Smyth there is actually another unit on the same line on a different floor in the same high rise for rent available now, not the same condition, but the current tenant is not willing to move out and i don't think it is a question of availability with her. I think the idea of eviction people are suggesting here is not to actually evict her but just to let her know about it so that she refrains from persisting to stay as an eviction in her history might cost her any future rental and a mortgage and a potential coop. I also would not go through eviction personally, I would rather try to talk it out unless she stops paying which again she is very careful with her credit etc so i don't think she will go that route.

@Adam Christopher Zaleskiundefined Hi Adam, this is the exact reason why i am here for, to hear how other LL's handle these situations. I am new to this, this was my first tenant and while i think i handled it well so far past two years, this was a surprise. When she told me she is buying a coop, i asked her if she realizes everything is pending on them approving her and that they may not if they choose to. She is a first time home buyer and has no clue and in my opinion completely underestimating her timeline. But the problem i have with her is, she is not upfront, she wouldn't say why she was leaving and only told me after the fact. When she gave me her notice, i did not know she was buying a house.  Now for me i prefer to have the other tenant in anyway because sooner or later she will be gone and i don't want to look for another tenant 3 months from now again. I have been very nice with her always and i think she probably thinks it is fine but i am not her mom!

@JD Martin thank you for the advice. This was very unexpected for me as the current tenant informed me about her situation very last minute and after the fact. As i mentioned, i told her to move out initially and she has reacted saying she'd be homeless vs taking responsibility and saying she can make other arrangements which was also unexpected for me (i know for a fact she has a partner and family nearby)I think I will maybe give her a day or two to cool down and approach again - then tell the prospective tenant what's going on if i cannot reach an agreement with the current tenant.

OK, but how do i have commitment from the tenant or the tenant has commitment from me if there is no lease since there is a month to go? 

Given my current situation, since he signed the leasee, do i tell the new tenant that i will collect the deposit and payment after the current tenant moves and explain to him the possibility? 

In the area where i am renting my unit, it IS very hard and rare to find a tenant this qualified, almost overqualified with income and credit especially post Covid. So i don't want to loose this tenant. About the turnover, the apartment is in excellent shape, the current tenant maintained it extremely well and the unit was painted and renovated fully right before she moved in two years ago. I think it could use a general cleaning but that can be done in an hour (it is a studio condo). There are no repairs or anything needed as of now.

Hi, yes i delivered a lease and he signed but i have NOT collected his deposit or first month's  rent yet. 

Thank you for the advice > I did not know that i had to wait to sign a lease until the unit was vacant. 

For the future > What do i normally do (had i not have him sign a lease) to make sure i don't loose this prospective tenant? Do i collect his deposit now, take the rental off market and then offer the lease at the beginning of his tenancy? 

Back to now, there is still a chance this current tenant might leave, she says she just doesn't know if she can finalize her purchase which makes me nervous because obviously i want to know if she is leaving or staying especially after she made me list the unit and go through all the work of finding a new tenant. I am afraid that if i loose this prospective tenant due to uncertainty and she buys her home and leaves at the same time, I will be left with a hard long winter. And i am definitely leaning with the new tenant because he is very prompt and reliable it seems unlike the current tenant who is hard to communicate and long term will be moving out anyway since she is looking for a house to buy and doesn't seem to realize the situation she is putting everyone in. 

@Scott M. I meant a lease. Below is a timeline if it wasn't clear above.

1.As i mentioned above my current tenant gave me a 60 day notice saying she wants to move an wishes not to renew her lease. She didn't say why. 

2. I advertised my apartment and found a new tenant. 

3.The new tenant passed all the background, credit checks etc. 

4. I offered him a lease which he signed. 

5. AFTER >The current tenant said she was in the process of buying a home which is why she wanted to move and that she is having issues with her coop appraisal and that she might loose the deal so she might need to stay in the apartment. 

6. i have a tenant who signed a lease to move in December 1st and another tenant whose lease is expiring Dec 1st who now says she doesn't want to move incase her purchase falls through. 

Question: how do i handle this situation and what are my obligations to them? I told the current tenant in my apartment that she should honor her 60 day notice and move out but she is saying she will be homeless if she can't purchase this home and has to move out of my apartment at the same time. 

@I know i am trying to avoid eviction etc and try to solve it the most amicable way i can but she doesn't realize that i can't wait on her homebuying process and taking advantage a bit.  

Hi everyone, 

I have a situation where i have a tenant in good standing and she gave me her 60 day notice to move out before lease renewal. I found a qualified new tenant and offered him a lease. The tenant in my apartment just broke the news to me that she is in the process of buying a home and that there was a problem with the bank's appraisal and that she might end up having to stay in the apartment after the fact. How do you think is the best to handle this situation? Would i have any issues if i had to withdraw the contract with the other tenant incase this one refuses to leave? Would i open myself up for any damages? I prefer to just have her leave and get the new tenant in because since she is on the market looking for a home purchase, I prefer to have a tenant who will stay there 2 yrs at least and the new tenant is solid financially and credit wise. She was the one who gave me the 60 day notice but now says she has nowhere to go. Any advice?
