If you are paying an attorney who specializes in evictions, why would you be trying to find other ways to evict the tenant?  You are paying for the lawyer's expertise and to make sure the eviction is legal so the tenant can't sue you for a wrongful eviction.

There should be a paragraph you check that says whether the contract is assignable or not.  I just went under contract to sell a property "as is" and the buyer had checked assignable and I had them change it to not assignable.

(3) The following persons are exempt from regulation under part III of this chapter:(a) A person acting in a fiduciary capacity conferred by the authority of a court.(b) A person who, as a seller of his or her own real property, receives one or more mortgages in a purchase money transaction.

Be careful if someone is trying to get you to put a nonrefundable deposit on a property to hold it.  I recently was bidding in an auction and another bidder had left bids.  He won (I ran him up quite a bit) and it turned out he was a scammer.  When you Googled his name, he had advertised properties using pictures which were not current.  One guy complained he sent in $1,600 nonrefundable towards the purchase price and went to see it prior to sending the rest of the down payment.  Turned out it was an empty lot where the house had burned down about 5 years before and the pics were from before the fire.  He was out the $1,600 (and there were several others posting similar situations with this guy).  I did manage to get the home under contract for my bid just over the last legitimate bidder instead of the bids I placed against the scammer.  This is a home that looks great from the Zillow pics, but needs extensive rehab.  BTW - the scammer wasn't a realtor and claimed to be a wholesaler (he's in the Tampa area), although he was selling properties in several states.

The clerk of court sent out a letter to attorneys stating they are hurting for fees and traffic ticket revenue. They are letting people file evictions and foreclosures since they get their fees at filing, not when the writs of possession issue. They also want to avoid huge backlogs when moratoriums end. I haven't had any tenants late with rent, but decided to sell my rentals when they are vacant while the market is high instead of taking a chance with new tenants just paying to get into a rental then not paying anything afterward. The last SFH I listed for sale hit the MLS on Tuesday and had a full price contract on Friday, with a couple of backup contracts. I was lucky the last tenant bought a home and I let her out of her lease early so I could get it on the market to sell before the end of the year.

In Marion County, FL, the clerk of court is taking eviction cases and you can go through the whole process except for issuing the Writ of Possession, since there is a moratorium on evictions.  As soon as the moratorium is lifted/expires, judges can start signing the writs.  Tenants may believe they can't be evicted and not answer any paperwork, allowing the landlord to get a default judgement and be ready to evict them.

My real estate agent works with a builder that builds quads in Ocala. She told me the hardest part is finding the land. I haven't looked into it since I buy SFH's. If you need a number, message me.

@Edwin L.  The reputation for the bad areas of Marion Oaks is theft and drugs.  For the Shores and the Forest is drugs, theft, and a haven for meth heads (forest).  You need a good realtor who will steer you away from the bad areas if you buy in either Marion Oaks or the Shores.  Both are too far from where I want to own rentals or for my repair people to travel.  I prefer to be in the county (lower taxes) but close enough for people who work in the distribution centers or downtown.  It is a personal preference since I self manage and am an older female - I have to feel safe to be able to go to anything I own by myself to collect rent or check on a rental.

I do not buy in Marion Oaks or the Shores as there are some good pockets in both, but they have a not so great reputation locally.  The huge distribution centers are next to the Interstate north of SR200, so not close to either neighborhood.  The new World Equestrian Center is on west HWY 40 between NW 80th Ave. and NW 100th Ave. - also a long distance from both neighborhoods.  Read this Facebook group to see rents and neighborhoods in Ocala  https://www.facebook.com/group...   I have wells and septic tanks on my properties and many homes that have "city water" are still on septic tanks.  The biggest problem I have is ants frying the pressure switches, which seem to happen nights and weekends - they are inexpensive ($15 - 20), and labor to replace is a service call fee.
